The Office of the Comptroller of the Currency (OCC) has finalized federal stablecoin regulations implementing the GENIUS Act, establishing binding requirements for reserve backing, redemptions, custody and risk management that will take effect on January 18, 2027.
The October 21 decision establishes supervisory standards for eligible U.S. payment stablecoin issuers, including national bank subsidiaries, federally approved nonbank issuers and qualifying foreign companies operating in the American market.
President Donald Trump signed the GENIUS Act on July 18, 2025. The finalization follows an earlier missed regulatory deadline in July 2026, when federal agencies had not completed the legislation’s required implementation rules.

OCC Establishes Stablecoin Reserve and Redemption Requirements

The new regulatory framework requires permitted payment stablecoin issuers to maintain reserves covering outstanding tokens on a one-to-one basis, using eligible assets including cash, bank deposits and short-term U.S. Treasury securities.
Issuers must publish monthly reserve composition reports, obtain independent accountant examinations and maintain adequate liquidity to meet customer withdrawals.
Redemption requests must generally be processed within two business days. The requirement is satisfied when an issuer completes processing and initiates the outgoing payment or credits the customer’s account, rather than necessarily when funds reach an external bank account.
The rules also introduce capital and operational safeguards, custody requirements and supervisory standards for foreign stablecoin issuers seeking access to U.S. customers.
State-level regulation will operate alongside federal oversight. New York previously proposed stablecoin rules designed to align its existing supervisory framework with the GENIUS Act.

OCC Eases Indirect Stablecoin Rewards Restrictions

One of the most significant changes involves the treatment of interest and rewards distributed through cryptocurrency platforms.
The GENIUS Act prohibits stablecoin issuers from paying interest or yield solely for holding, using or retaining their payment stablecoins. However, the OCC removed a proposed rebuttable presumption that would have treated certain arrangements involving affiliates and third parties as violations.
Rather than automatically restricting these arrangements, the regulator will evaluate potentially prohibited rewards and yield programs individually through licensing reviews and ongoing supervision.
The change does not authorize every stablecoin rewards program. The OCC retains authority to investigate arrangements designed to circumvent the statutory prohibition and may introduce additional rules as the market develops.
The American Bankers Association criticized the decision, arguing that crypto platforms could continue offering economically equivalent yields through intermediaries while traditional banks face tighter restrictions.
ABA President and CEO Rob Nichols warned that the approach could accelerate deposit withdrawals from community banks and weaken their capacity to finance local lending.

Treasury Secretary Scott Bessent and Comptroller Jonathan Gould welcomed the finalized framework as a foundation for expanding regulated digital asset payments in the United States.
The framework also affects institutions preparing to enter the stablecoin market, including Augustus National Bank, which received preliminary OCC charter approval in May for a banking platform that includes a proposed stablecoin subsidiary.
Existing issuers with substantially complete applications pending by the effective date may request temporary waivers lasting up to 12 months. Such relief is discretionary and does not constitute automatic licensing approval.
Separate anti-money laundering and sanctions regulations remain unfinished and will be addressed with the Treasury Department.
The OCC has not yet opened its stablecoin issuer application process, pending final Office of Management and Budget approval of the required forms. The agency will announce when applications and waiver requests can be submitted, ahead of the January 18, 2027 compliance deadline.
