Switzerland has approved its first spot Bitcoin exchange-traded fund under domestic collective investment legislation, introducing a new legal structure for retail investors in a market already served by physically backed cryptocurrency products.

The Swiss Financial Market Supervisory Authority (FINMA) announced the authorization on October 20, 2026. The fund will invest directly in Bitcoin and operate as an other fund for alternative investments with particular risks under Switzerland’s Collective Investment Schemes Act (CISA).

FINMA also granted an exemption from diversification requirements, allowing the portfolio to concentrate on Bitcoin. The regulator cited the cryptocurrency’s established trading history and substantial market liquidity.

The approval creates a new regulated investment channel rather than introducing Bitcoin exposure to Switzerland for the first time. Products from 21Shares, WisdomTree and other issuers have traded on Swiss exchanges for years.

The distinction lies in how the investment is legally structured, how its assets are protected and what obligations apply to the fund’s operators.

Fund Law vs. Debt ETPs: The Legal Difference

Most established Swiss-listed Bitcoin exchange-traded products are structured as debt securities issued by financial institutions. Their underlying Bitcoin holdings serve as backing or collateral, with investor rights defined by the relevant securities documentation.

The newly approved ETF instead falls under CISA, including Article 68, which governs other funds for alternative investments.

Swiss collective investment legislation imposes requirements concerning fund management, custody and the treatment of fund assets. These provisions can affect investors’ legal position if a fund management company becomes insolvent.

Debt-based ETPs follow a different framework. Investors’ recovery rights depend on the issuer’s obligations, collateral arrangements and the enforceability of security interests.

That does not make every ETP an unsecured investment. Physically backed products may employ pledged collateral, independent custodians and other mechanisms intended to protect investors.

The practical distinction is the source of those protections: statutory collective investment rules for the new ETF versus product-specific contractual and collateral arrangements for ETPs.

FINMA previously authorized a cryptocurrency investment fund in 2021, but that product was restricted to qualified investors. The October 2026 decision extends the domestic fund framework to a Bitcoin investment product accessible to retail clients.

Why FINMA Allowed a Single-Asset Bitcoin Fund

Diversification requirements ordinarily limit concentration within collective investment portfolios. A fund designed to hold only Bitcoin would conflict with that principle without a regulatory exemption.

FINMA accepted the concentration after assessing Bitcoin’s trading history and comparatively deep liquidity.

Market depth is relevant to an ETF’s daily operations. The fund must value its holdings and execute transactions associated with subscriptions and redemptions, potentially during periods of elevated trading activity.

Bitcoin’s established market provides a stronger operational basis for those activities than a thinly traded digital asset.

The regulator has not published a universal liquidity threshold that other cryptocurrencies could use to qualify for an equivalent exemption.

Future applications involving Ether or smaller tokens would therefore require their own supervisory assessment. FINMA’s decision establishes a precedent for a Bitcoin-specific fund, not automatic approval for single-asset cryptocurrency ETFs generally.

How the New ETF Compares With Existing Swiss Bitcoin Products

Swiss investors already have several routes to Bitcoin exposure, including the 21Shares Bitcoin ETP (ABTC) and WisdomTree Physical Bitcoin.

Both provide exchange-traded exposure backed by Bitcoin, although their legal documentation, custody arrangements and commercial terms differ.

The comparison below separates the three main approaches by legal structure, asset protection and tax considerations.

Note: Legal and tax treatment depends on the product structure and investor circumstances. The new ETF’s full terms remain unpublished.

The table highlights why the new fund’s prospectus will matter more than its ETF designation.

Existing ETP issuers publish information about product fees, collateral arrangements and custody providers. These disclosures allow investors to assess the cost of holding Bitcoin exposure through a brokerage account.

For the newly approved ETF, those details have not yet been released.

The most relevant comparison will combine the fund’s expense ratio with trading spreads, custody protections and the treatment of assets if an intermediary becomes insolvent.

Swiss Bitcoin ETF Taxes: Capital Gains and Withholding Tax

Tax treatment could influence the relative appeal of the new exchange traded fund, existing ETPs and direct Bitcoin ownership.

Under Swiss federal law, capital gains realized by private investors are generally exempt from income tax, provided their activity does not qualify as professional securities trading. Collective investment funds, however, follow additional income attribution and reporting requirements.

Three considerations deserve particular attention:

Capital gains: Article 20 of the Federal Direct Tax Act addresses income from collective investments. Separately reported capital gains may receive different treatment from taxable investment income.

Withholding tax: Swiss domestic investment funds may be subject to a 35% withholding tax on taxable distributions or accumulated income. Eligible Swiss taxpayers can generally reclaim it by properly declaring their income and assets.

Wealth tax: Bitcoin holdings and investment fund shares generally form part of taxable wealth for Swiss residents, subject to applicable cantonal rules.

The 35% withholding rate is not automatically a tax on Bitcoin price appreciation. Its application depends on the fund’s income sources, accounting and distribution arrangements.

Bitcoin does not generate conventional dividends or interest. Nevertheless, the ETF’s specific reporting classifications will need to be examined once its prospectus and tax documentation become available.

The Swiss Federal Tax Administration provides the general withholding-tax framework. Investors comparing products will also need to consider their own tax residency and classification.

Custody Rules Put Asset Segregation Under Scrutiny

The ETF’s regulatory structure brings cryptocurrency custody arrangements within the supervisory requirements applicable to the fund and its service providers.

In January 2026 guidance, FINMA addressed risks associated with cryptocurrency custody, particularly where supervised institutions rely on third-party providers or arrangements involving foreign jurisdictions.

A central concern is whether clients’ digital assets remain identifiable and legally protected if a custodian becomes insolvent.

The regulator expects supervised institutions to assess operational safeguards, legal enforceability and the risks of outsourcing. Delegating custody does not remove an institution’s supervisory responsibilities.

For the new ETF, the identity of the Bitcoin custodian and the applicable asset-segregation arrangements will be important disclosures.

Retail distribution also falls within Switzerland’s Financial Services Act (FinSA). Financial intermediaries must provide applicable risk information and conduct appropriateness or suitability assessments where required by the services offered.

These requirements are particularly relevant to banks and investment advisers offering the fund through conventional securities accounts.

Issuer, Fees and Launch Date Remain Unconfirmed

FINMA’s October 20 announcement did not identify the approved ETF’s issuer or disclose its final commercial terms.

Swiss financial publication finews has reported a possible connection to BIT Asset Management, formerly Matrixport Asset Management. Neither FINMA nor the company has confirmed that connection.

Four details remain essential for evaluating the product:

Issuer and ticker: The fund operator and trading symbol have not been officially identified.

Management fees: The expense ratio remains undisclosed, preventing a direct cost comparison with established Bitcoin ETPs.

Custody arrangements: The custodian, asset-segregation procedures and applicable insolvency protections require confirmation in the product documentation.

Listing and launch date: FINMA has not announced when or where trading will begin.

FINMA has also indicated that other providers have submitted or announced applications for Bitcoin ETFs, opening the possibility of further competition within Switzerland’s regulated fund market.

For existing ETP issuers, the new product introduces competition based on legal structure as well as pricing. For investors, the decisive information will come from the prospectus, particularly its custody terms, expense ratio, redemption procedures and tax reporting.

Until those details are available, the authorization establishes a regulatory milestone without demonstrating that the new ETF offers a financial advantage over products already trading in Switzerland.
