The U.S. Department of Justice is scrutinising whether Binance is meeting the obligations attached to its landmark 2023 criminal settlement, DOJ Criminal Division head Tysen Duva confirmed in October 2026. The review runs alongside a separate investigation into possible Iran-sanctions violations, though neither Binance nor its employees have been accused of wrongdoing in that matter.

What the Reported DOJ Scrutiny Involves

Duva confirmed in an October 10 report by The Straits Times, which attributes the underlying reporting to Bloomberg, that the DOJ has an ongoing review of Binance's compliance with the 2023 agreement. He declined to discuss specific facts or the current status of that review.
The Iran-sanctions probe is connected to, but distinct from, the settlement-compliance review. As The Straits Times makes clear, an investigation can conclude without charges or legal action; the existence of scrutiny is not a finding of breach.
Why post-settlement compliance reviews matter

When a company enters a deferred prosecution or criminal resolution agreement, it typically accepts continuing obligations: remediation steps, cooperation with monitors, and compliance upgrades. Regulators retain the authority to review whether those commitments are being honored for the full term of the agreement. A compliance review is a standard oversight tool, not an automatic escalation.
The Scale of Binance's 2023 Settlement

On November 21, 2023, DOJ announced that Binance pleaded guilty to conspiracy to violate the Bank Secrecy Act, failure to register as a money transmitting business, and violations of the International Emergency Economic Powers Act. The exchange agreed to pay $4.3 billion and retain an independent compliance monitor.
Separately, OFAC's sanctions settlement totalled $968,618,825, resolving 1,667,153 apparent violations across multiple sanctions programs. That agreement imposed a five-year independent compliance monitor with a specific sanctions-compliance remit, meaning oversight remains active through at least 2028.

The distinction between settlement and compliance oversight

Binance's 2023 resolution did not simply impose a fine and close the case. It created forward-looking obligations that the DOJ and OFAC monitor for the duration of the agreement. The current reporting describes a review of those forward-looking commitments, not a new charge or a confirmed finding that the exchange violated its terms.

Binance said it is "continually working to enhance our controls" and is "fully committed to cooperating with law enforcement," according to The Straits Times report.

What to Watch Next

BNB was trading at $740.57 at the time of writing, down 1.16% over 24 hours, with a market cap near $98.6 billion. Broader crypto sentiment sits at 57 on the Fear & Greed Index, in "Greed" territory, suggesting the market is not yet pricing in material downside from the review. Regulatory developments in the crypto sector have previously driven sharp volatility, as seen when Bitcoin volatility spiked alongside liquidations topping $800M.

The signals worth watching: an official DOJ statement confirming or closing the compliance review; any court filings in the United States v. Binance Holdings case; a public response from the independent monitor; or a formal Binance disclosure. Until one of those surfaces, the current reporting establishes scrutiny, not a breach. A narrowing in that gap would be the material development to track.
