Thailand Clears Path for Spot Crypto ETFs

Thailand's Securities and Exchange Commission (SEC) has finalized rules allowing spot exchange-traded funds backed by $BTC and $ETH to list on the Stock Exchange of Thailand (SET). The country's financial watchdog published rules allowing local asset managers to list passive spot ETFs on the Stock Exchange of Thailand beginning October 16.

The framework is notable for its structure. The funds must trade on the Stock Exchange of Thailand, invest at least 80% of their net assets in a single eligible cryptocurrency, and use custodians regulated by Thai authorities. The SEC approved 11 notices requiring each ETF to track a single crypto and hold at least 80% of its value in that asset.

No specific Bitcoin or Ether ETF products have received approval under the new framework yet, meaning October 16 marks the effective date for the regulatory framework itself, not necessarily the launch of individual products.

Institutional Access, Retail Guardrails

The approval opens a regulated channel for wealth managers and institutional participants. The SEC also modified rules for local market participants, allowing domestic mutual funds and private funds to invest in Thai-based crypto ETFs.Previously, such investments were limited to offshore crypto ETF offerings.

Retail investors, however, face tighter limits for now. Investors must acknowledge the risks before buying, while brokers cannot lend clients money for crypto purchases, and retail investors will initially remain barred from products offering indirect access to foreign crypto ETFs.Thai brokers are not permitted to facilitate retail investors' access to overseas crypto ETFs, with direct investment in international digital asset funds remaining permissible only for institutional and ultra-high-net-worth clients.

The framework gives investors regulated exposure to crypto assets without directly buying or storing digital assets. The move draws comparisons to the US, where spot Bitcoin and Ethereum ETFs launched in 2024 and opened new institutional channels. The regulatory authority stated that feedback to its consultations held earlier in the year favored the proposed framework.
