A Landmark Bill Falls Short

The Digital Asset Market Clarity Act, the most ambitious attempt yet to establish a comprehensive regulatory framework for crypto in the United States, is effectively dead for 2026. On September 15, a cloture vote in the US Senate failed on the bill, known as the CLARITY Act.A 49-50 vote fell far short of the 60 supporters required to advance.
The bill would have formally split oversight of the crypto sector across the SEC and the CFTC, with the CFTC playing a larger regulatory role. The vote followed weeks of negotiation and a series of last-minute drafting changes, and its outcome effectively halts comprehensive crypto market structure work in the Senate for 2026.
All Senate Democrats voted no, joined by four Republicans: Susan Collins of Maine, Josh Hawley of Missouri, Jerry Moran of Kansas, and Thom Tillis of North Carolina. Republicans hold a 53-seat majority, meaning they needed roughly seven Democrats to cross over to clear the 60-vote threshold.

Speaking at CoinDesk's Policy and Regulation event on September 22, Senator Cynthia Lummis of Wyoming did not hold back. Lummis said she was "dismayed, dumbfounded and saddened" that the Senate could not advance the bill, and blamed Democrats directly for its failure. She argued that opposition to Donald Trump had overtaken any appetite for sound policy.
Democrats had raised their own concerns throughout the months-long negotiation process, centering largely on ethics provisions. They pushed for restrictions on the ability of elected officials to profit from the crypto industry, amid concerns about President Trump and his family's crypto-related ventures. The White House approved ethics language in late July barring public officials and their spouses from issuing or sponsoring digital assets, with enforcement handled by the Department of Justice.Democrats pushed back on that provision, arguing state attorneys general should lead enforcement instead.
The bill itself had grown substantially during negotiations. What started as a roughly 300-page proposal expanded to more than 600 pages as both parties traded demands. Lummis argued that Democrats had secured more than 100 revisions to the bill, framing Republican concessions as evidence of good faith. Democrats were not persuaded.
The failed vote likely means the crypto industry will have to wait until next year for clearer rules. Both the SEC chairman and CFTC chairman have promised to continue advancing crypto rulemaking even without congressional action.
