A Senate Banking Committee minority staff analysis renewed Democratic objections that the bill preserves pathways for President Trump to continue profiting from crypto ventures, after disclosures showed about $1.4 billion in 2025 earnings tied to his crypto activities.</p><p>The CLARITY Act has already cleared the House by a 294-134 margin in July 2025 and cleared the Senate Banking Committee through a 15-9 bipartisan vote in May 2026. Supporters argue the legislation would provide a durable statutory framework for crypto oversight. The SEC and CFTC's joint interpretive guidance classifying digital assets can be rescinded overnight by any future administration without a congressional vote, and only a statute survives a change of administration intact.</p><p>Prediction markets reflect deepening skepticism about the bill's near-term prospects. Polymarket currently prices 2026 passage at just 16%, down sharply from highs above 80% earlier this year. Galaxy Research has also cut its estimated probability of CLARITY Act enactment in 2026 from 50% to 30%.
