A ruling by the Hangzhou Internet Court in the “Fat Tiger Gets Vaccinated” NFT infringement case makes it clear: decentralization does not mean freedom from liability, and behind technology, there are still clear legal boundaries.

Many people assume that if they only develop technology, build platforms, or provide tools without directly participating in infringement, they will be fine. However, this ruling clearly states that technology itself cannot serve as a “shield” for infringement—if used improperly, it can still lead to legal violations.

In this article, we will discuss a crucial yet often overlooked concept: “copyright infringement via technical evasion.”

What exactly is it?

How can ordinary individuals avoid it?

And how can we strike a balance between innovation and compliance?

Technical Evasion-Based Infringement: A Fatal Shortcut to Bypassing “Digital Locks”

In the fields of Web3 and digital creation, there is a type of infringement that is often underestimated: it does not involve directly stealing content, but rather bypassing the “digital locks” that protect content—such as cracking encryption, tampering with authorization protocols, or providing cracking tools. Although such acts seem indirect, they are actually more harmful: it is like having a master key, opening the door to large-scale infringement.

These “digital locks” mainly fall into two categories:

Access control measures: Such as paywalls and membership verification, which determine whether you “can enter the door”;

Copyright protection measures: Such as anti-copy watermarks and DRM (Digital Rights Management) systems, which restrict “what you can do after entering the door.”

Evasion behaviors are also divided into two types:

Direct evasion: Cracking by oneself, equivalent to “making a key for personal use”;

Indirect evasion: Creating or providing cracking tools, equivalent to “running a factory that produces master keys.”

The reason why the law severely cracks down on such acts is that they enable “large-scale” infringement: a single cracking tool may be used by thousands of people, seriously disrupting the copyright order and creative ecosystem.

The “Evasion Mine” in Web3: When Technical Bypasses Meet Immutable Blockchains

After understanding the basic concept, let’s take a look at how it becomes distorted in the Web3 context.

Wider range of evasion targets: In the past, cracking was aimed at a specific piece of software; now, it may involve attacking a blockchain protocol that verifies the copyright of AI training data, or tampering with the logic of a smart contract that determines NFT access rights. The “lock” has evolved into a virtual consensus.

More complex actors: For example, a developer open-sources a script that bypasses the technical protection measures of a certain platform on GitHub, receives funding through a DAO (Decentralized Autonomous Organization), and has the script automatically executed by anonymous nodes worldwide. In this case, the involved actors transcend geographical boundaries—including the developer, the DAO that voted to approve the funding, and all executing nodes…

Infringement consequences are permanently recorded: In traditional networks, infringing content can be deleted. However, in Web3, common legal orders such as “ceasing infringement” and “eliminating adverse effects” become technically difficult to enforce. The infringing state may be permanently locked, and the damage to the right holder continues indefinitely, with no way to reverse it.

The law has already set clear red lines for this: According to the Interpretation of the Supreme People’s Court and the Supreme People’s Procuratorate on Several Issues Concerning the Application of Law in Handling Criminal Cases of Infringing on Intellectual Property Rights, providing tools or services specifically used to bypass copyright protection measures can constitute a criminal offense if the circumstances are serious. If project parties cross this line, they will face direct legal sanctions; platform parties also cannot claim “technical neutrality” to avoid liability—they are obligated to conduct preliminary reviews, otherwise they may bear joint liability.

Establishing a Compliance Guide: How to Move Forward Safely in the Web3 Era

Faced with the legal risks brought by technical evasion, compliance is no longer an “option” but a “lifeline” for the survival and development of Web3 projects. True compliance requires collaborative efforts in law, technology, and community governance:

From “passive exemption” to “proactive governance”: For platforms with substantial control, the role of lawyers has shifted from seeking “safe harbor” protection to helping establish a copyright governance system that matches the platform’s capabilities. This involves converting legal obligations into enforceable monitoring checklists, such as smart contract audit mechanisms and high-risk content monitoring.

Compliance must be “introduced in advance”: In the early stages of token model design and technical solution selection, professional legal opinions should be sought to fundamentally prevent the risk of evasion-based infringement. If problems have already arisen, professional defense is needed to clarify the boundary between “technical exploration” and “malicious illegal acts.”

Professional support is a long-term guarantee: In the Web3 field where rules are still evolving, compliance construction requires teams that understand both technology and law. If you or your project face related risks or need to build a compliance framework, it is recommended to contact professional teams such as Mankun Lawyers to obtain full-cycle support from model design to risk response.

Only by embedding compliance awareness into the “genes” of a project and using a forward-looking framework to address potential risks can we move further in balancing innovation and security.
