Custodia Bank, a Wyoming-chartered crypto depository institution, has asked the United States Supreme Court to intervene in its long-running dispute with the Federal Reserve over access to a master account, characterizing the Fed's conduct as an unchecked exercise of power over state-chartered banks seeking entry into the federal payment system.

The petition escalates a legal battle that has moved through lower federal courts after the Federal Reserve denied Custodia's master account application. A master account grants direct access to the Fed's payment rails, allowing banks to settle transactions without routing through a correspondent bank. Without one, Custodia cannot operate as a full-service depository institution, regardless of its Wyoming state charter.
Custodia's legal team framed the denial as more than an administrative setback, arguing the Fed exercised unreviewable discretion in a way that effectively blocks state-chartered crypto banks from the federal banking system. The word "tyranny" in Custodia's filing, as reported by Bitcoin.com News, reflects the bank's position that the Fed's authority over master accounts has no meaningful judicial check.
The Master Account Dispute and What It Means for Crypto Banks

The Federal Reserve issued guidelines in August 2022 establishing a tiered review framework for master account applications from novel institutions, including those with crypto-focused business models. That framework gave the Fed broad latitude to weigh risk factors without defining a clear timeline or binding standard for approval. More on this in Why Is Cosmos Hub (ATOM) Price Down Today?.

Custodia's core legal argument is that this latitude crossed into something more troubling: a system where a federal agency can indefinitely deny access to public financial infrastructure with no meaningful standard of review. The bank contends that this gives the Fed de facto veto power over which business models are permitted to exist as functioning depository institutions, not merely which ones qualify for federal insurance.

The practical stakes extend beyond Custodia. Any crypto-native bank seeking a state charter and direct Fed access faces the same bottleneck. The case touches directly on whether state banking innovation can survive federal infrastructure gatekeeping, a tension that has shaped discussions around crypto banking access for several years. Regulatory friction of this kind also affects broader market access for digital asset firms, a dynamic familiar to anyone watching crypto market conditions tighten under regulatory pressure.

Custodia's Arguments to the Justices

Custodia is asking the Supreme Court to take up the question of whether the Federal Reserve Board has unreviewable discretion to deny a master account to a state-chartered bank that meets the statutory eligibility requirements under the Federal Reserve Act. The bank argues that lower courts failed to adequately scrutinize the Fed's reasoning, accepting the denial without demanding a standard against which the decision could be measured.

The petition frames the issue as a constitutional and statutory one, not simply a dispute over administrative process. If the Fed can deny master account access without a reviewable standard, state-chartered institutions operate at the Fed's pleasure rather than within a defined legal framework. Custodia's lawyers argue this is incompatible with the structure of the Federal Reserve Act and the role Congress intended for state banking charters.

This argument carries particular weight in the current environment, where Wyoming's Special Purpose Depository Institution charter was specifically designed to bring crypto-native businesses under state regulatory oversight, creating a supervised pathway that the Fed's master account process has effectively blocked.

What to Watch as the Court Considers the Petition

The Supreme Court accepts a small fraction of petitions each term. Custodia's petition does not guarantee the Court will hear the case; certiorari requires four justices to agree the question merits review. The Fed will have the opportunity to file a response opposing certiorari, and that filing will be a key signal of how the federal government characterizes the scope of its own discretion.

If the Court declines to take the case, Custodia's options narrow significantly and the lower court rulings stand. If the Court accepts, oral argument would likely set up a direct ruling on the boundaries of the Fed's authority over master accounts, a question with lasting implications for any novel financial institution seeking entry to the U.S. payment system.

The broader regulatory context is unsettled. Federal banking regulators have sent mixed signals on crypto banking access over the past several years, alternating between restrictive guidance and conditional openness. Custodia's petition represents one of the most direct legal challenges yet to the Fed's unilateral control over that access, and the Court's decision whether to hear it will itself be a meaningful data point for how the judiciary views federal agency discretion in this area. Legal watchers tracking the intersection of crypto and federal regulation should note this case alongside other enforcement actions reshaping the digital asset compliance landscape.
