Swap

Time

Bitcoin

Anyone planning to swap Bitcoin for gold usually asks first whether the tax office will even notice. The short answer: a swap is a sale for tax purposes, and whether tax falls due hangs on a single number — how long you held the coins beforehand. After more than a year the gain stays tax-free; below that it counts as a private disposal. Receiving a gold bar rather than euros changes nothing about that.

The appeal is obvious. Many investors treat gold as the quieter part of their wealth, and some precious-metal dealers now accept Bitcoin directly as payment. That direct route, though, leads to the same tax calculation as the detour through a current account. This article sets out which rule applies, how to work out the gain, which records you need and where the pitfalls sit.

Swapping Bitcoin for gold is a sale in tax terms

Under German tax law a swap is not a transaction of its own but two at once: you dispose of one asset and acquire the other in the same moment. The Bitcoin therefore counts as sold the moment the dealer hands over the gold, and the gold counts as bought on that day.

The technical term is a private disposal, a privates Veräußerungsgeschäft. It appears in section 23 of the German Income Tax Act, which in paragraph 1 sentence 1 number 2 covers "disposals of other assets where the period between acquisition and disposal is no more than one year". Crypto assets fall under those other assets, and so does gold.

The whole calculation rests on that. No rule treats a swap for physical assets more leniently than a sale for euros, and there is no rollover provision that would let a gain travel into the new asset, as is possible with business reinvestments. In private wealth the bill falls due as soon as the coins change hands.

The one-year period under section 23 settles whether tax is due

If more than twelve months lie between purchase and swap, the gain is tax-free, however large it turns out to be. If less than twelve months lie between them, it is taxable in full at your personal income tax rate. There is no middle ground and no pro-rata taxation.

What counts is the day you acquired the individual coins, not the day you opened the account. Anyone who bought in tranches over several months therefore holds positions at different stages of the clock. Which units leave on a swap depends on the cost-flow method in your records; the tax office usually works on the principle that the units acquired first are the first to go. The evidence that counts here is set out in our article on which records prove a holding period of more than a year.

One special case concerns coins that earned you income on the side. Section 23 paragraph 1 sentence 1 number 2 sentence 4 extends the period to ten years where an asset generates "income in at least one calendar year". Whether that extension bites on staking and lending has been disputed for years, and the tax administration now answers it differently than in its first drafts. If it affects you, settle it before the swap, not after.

How the disposal proceeds are measured in a swap

On a sale for euros the proceeds appear on the statement. On a swap for gold they appear nowhere, and this is where most errors arise. The disposal proceeds are the value of what you receive, which means the euro value of the gold at the time of the swap.

The calculation follows section 23 paragraph 3 sentence 1: the gain is the difference between the disposal proceeds on one side and the acquisition costs plus related expenses on the other. An example with round numbers: you bought half a Bitcoin for 30,000 euros and swap it eight months later for gold bars whose dealer price that day is 38,000 euros. The taxable gain is 8,000 euros, less the costs directly connected with the transaction.

Those related expenses include the blockchain transaction fee, an exchange trading fee or a stated dealer surcharge for settling in cryptocurrency. Not deductible are the running costs of storing the gold afterwards, because they no longer belong to the disposal itself.

The 1,000-euro threshold covers all private disposals together

Section 23 paragraph 3 sentence 5 reads: "Gains remain tax-free if the total gain from private disposals in the calendar year was less than 1,000 euros." The word total is the decisive part. It means the sum of all private disposals in a year, not the single swap.

It is also a threshold, not an allowance. The difference costs money: at a total gain of 999 euros everything stays tax-free, at 1,000 euros the full amount becomes taxable, not just the euro above the line. Anyone with other transactions in the same year — a sale of coins for euros, a swap between two crypto assets, the sale of a coin collection — adds them all together.

A direct swap and the detour via euros end in the same place

Many assume the direct swap at a dealer is treated more favourably than the classic route, where you first sell the coins for euros on an exchange and buy gold with the proceeds. In tax terms that is wrong. Both routes trigger the same disposal, both are calculated under the same provision, and in both cases a new period starts for the gold on the same day.

One difference remains, and it sits outside tax law: cost and traceability. Selling through an exchange gives you a statement with price, timestamp and fee that you can carry into your tax return unchanged. A direct swap at a precious-metal dealer gives you an invoice for gold, and the Bitcoin price the dealer applied is not always on it. If you take the direct route, ask for that price in writing. How far trading venue costs diverge is shown in our comparison of crypto exchanges.

A fresh one-year period starts for the gold on the swap date

The gold you receive is newly acquired for tax purposes. Physical investment gold also falls under the other assets of section 23, and the one-year period applies there too: sell the bars at a profit within twelve months and that gain is taxable; after that it is not.

The acquisition cost of the gold is the same value you used as disposal proceeds for the Bitcoin. The figure therefore appears twice, once as the end of one calculation and once as the start of the other. Record it cleanly at the time of the swap and you have no problem years later; estimate it and you carry two uncertainties instead of one.

Gold in securitised form follows its own rules, which differ by structure. For products carrying a claim to delivery of the metal, the courts have accepted treatment like physical gold; for pure derivatives the flat-rate withholding tax applies instead. It is worth reading the product documents before buying.

Investment gold is exempt from VAT, the Bitcoin gain is not

One point causes confusion again and again. The supply of investment gold is exempt from VAT under section 25c of the German VAT Act, and expressly so even where the gold is traded as a certificate, through a gold account or as a futures contract. That is why you pay no 19 percent on bars and bullion coins.

That exemption, however, covers only the VAT on the gold side. It says nothing about the income tax on your Bitcoin gain. The two taxes stand side by side, and neither cancels the other. Silver sits differently: VAT falls due on purchase there, which shifts the calculation on a swap.

Which records the tax office asks for on a swap

The tax administration set out its requirements for cooperation on crypto assets in detail in the German Federal Ministry of Finance circular of 6 March 2025; it replaces the earlier version of 10 May 2022 and devotes a separate section to record-keeping and cooperation duties. In practice, a swap for gold needs four pieces of information.

Acquisition of the coins: date, quantity and purchase price in euros, ideally with the exchange statement.

Time of the swap: the date and, if prices moved sharply that day, the time.

Value of the gold: the dealer invoice with weight, fineness and euro amount.

Bitcoin price applied: the conversion rate the dealer used, or price evidence from an exchange for the same moment.

If one of these is missing, the tax office estimates, and the estimate rarely falls in your favour. To avoid keeping the records by hand, the comparison of crypto tax software lists programs that book swaps as disposals, a point where simple portfolio apps often fail.

Losses from a swap offset only against disposal gains

If the euro value of the gold comes out below your acquisition cost for the coins, you have a loss from a private disposal. That loss is not worthless, but it is boxed in: under section 23 paragraph 3 sentence 7 it may only be set against gains you made from private disposals in the same calendar year.

Anything left over goes back to the previous year under sentence 8, or forward into later years, but again only against gains of the same kind. Such a loss cannot be set against your salary or against interest. In every case the transaction has to appear in your tax return; a loss you never declared is not available later. How to evidence losses is covered in our article on documenting crypto losses properly.

Our view: the swap does not solve the tax problem, it postpones it

From the editorial side, the move into gold is often sold with an advantage it does not have. The evidence sits in the provisions themselves: section 23 paragraph 1 knows no exception for swaps, section 23 paragraph 3 sentence 1 measures the proceeds by the value of what is received, and section 25c of the VAT Act exempts only the gold supply from VAT. Swap before the year is up and you pay the same tax as on a sale for euros, and you additionally hold an asset whose own one-year period starts at zero.

None of that argues against buying gold, since nobody splits their wealth by the tax table. It does argue against leaving the timing of the swap to chance. If the anniversary of the purchase is close, waiting costs nothing but patience. And it remains true: prices can fall, with Bitcoin as with gold, and a total loss cannot be ruled out with crypto assets.

What the planned holding-period reform could change

The one-year period is politically in motion. Changes to the taxation of private disposals of crypto assets have been under discussion for months, and depending on the outcome the calculation in this article shifts at exactly one point: when a gain becomes tax-free. We track the current state on our page on the reform of the crypto holding period.

Until something is passed there, the version of the law quoted above applies. If you are planning a swap, calculate with the law in force and not with a draft. A related case where the same logic applies is a swap for a gift card: a disposal arises there too, as we showed in our article on swapping Bitcoin for gift cards.

Bitcoin for gold: the euro value on the swap date settles the bill

Three points count if you are seriously weighing the move.

Look at the holding period before you swap. Your transaction history shows when the units due to leave were acquired. If the anniversary is within reach, waiting is the cheapest measure. For a clean overview, the programs in the comparison of crypto tax software provide one.

Secure the applied price in writing. Have the dealer confirm the conversion rate and the time, or sell for euros first on a venue that issues a statement. Which venues do so at which fees is set out in the comparison of crypto exchanges.

Declare the transaction on the Anlage SO form. Even a tax-free swap after more than a year belongs on the form if the tax office asks for it; a loss belongs there in any case, or it is gone. For larger amounts, or for coins from staking and lending, a question to a tax adviser pays off. To settle the sale through a venue licensed in the EU, the providers are listed in the comparison of MiCA-regulated crypto exchanges.
