Hyperliquid, the decentralized perpetual futures exchange, has submitted five proposed changes to a U.S. Securities and Exchange Commission crypto proposal, according to a report by U.Today. The recommendations target what the protocol describes as critical deficiencies in the SEC's current framework, with the submission placing Hyperliquid among the DeFi-native protocols seeking to shape U.S. crypto market regulation from within the formal comment process.

The move marks a notable escalation in direct regulatory engagement from decentralized exchange infrastructure. Hyperliquid operates as a layer-1 blockchain optimized for on-chain order book trading in perpetual futures, a segment of the market the SEC has increasingly scrutinized under its existing securities and derivatives authority frameworks.
What to Know: Hyperliquid's Five-Point SEC Submission

Hyperliquid submitted five distinct recommendations targeting an active SEC crypto proposal, per reporting from U.Today.

The submission engages the SEC's formal comment process, the same rulemaking channel where crypto custodians and exchange operators have submitted competing frameworks. The SEC maintains a public record of comment letters at SEC.gov.

No SEC response or acknowledgment of Hyperliquid's specific proposals has been confirmed as of publication.

The five specific recommendations have not been independently verified against the primary filing as of this article's publication. The description of each proposed change should be drawn directly from Hyperliquid's official submission or the SEC's public comment docket before treating any characterization as confirmed. Where only a single secondary report is available, the claims remain subject to revision pending primary-source confirmation. The comment-letter model has precedent: Ethena Foundation's recent fee switch proposal similarly used a formal governance submission to signal a protocol's policy direction to regulators and token holders simultaneously.

The Regulatory Context: SEC Crypto Rulemaking and DeFi Protocols

The SEC has advanced several crypto-specific proposals in the current rulemaking cycle, addressing digital asset custody obligations for registered investment advisers and broker-dealers. Those proposals drew extensive industry comment, with crypto-native firms arguing existing custody rules were designed for centralized intermediaries and do not map to on-chain self-custody architectures.

Hyperliquid's intervention follows a pattern of DeFi protocols submitting formal comment letters as SEC proposals advance toward finalization. The comment process is a legally recognized mechanism under the Administrative Procedure Act; the SEC is required to consider and respond to substantive comments before adopting a final rule, meaning well-constructed submissions can alter rule text, add exemptions, or force the agency to justify positions it may otherwise leave unexplained.

The SEC has previously entered periods of reduced rulemaking velocity, including a grant hiatus that paused new crypto ETF reviews, which affected the timeline for several pending applications. Comment letters submitted during active proposal windows carry more procedural weight than those filed outside designated comment periods.

Why a DeFi Protocol Submitting to the SEC Carries Structural Weight

Hyperliquid's participation in the SEC process is notable because decentralized exchange protocols have historically operated outside formal regulatory channels, often on the argument that on-chain, non-custodial infrastructure falls outside the SEC's jurisdiction over securities exchanges and broker-dealers. A voluntary submission of five specific recommendations implicitly acknowledges the agency's relevance to the protocol's operating environment, whether or not Hyperliquid concedes the SEC's direct authority.

Payward, the operator of the Kraken exchange, recently moved to offer Hyperliquid perpetual futures to U.S. clients, a development that increases the protocol's regulatory surface area in the U.S. market. That expansion means SEC rulemaking affecting perpetual futures or decentralized exchange infrastructure has direct commercial implications for Hyperliquid's product reach among American users.

Other regulators have moved separately on crypto product exposure. The FCA, for instance, proposed a 10% crypto ETN cap for UK retail funds, illustrating how different jurisdictions are calibrating their exposure limits through rule proposals rather than outright bans. The SEC's current proposal sits within a comparable calibration exercise for U.S. markets.

What Comes Next in the SEC Comment Process

Once a comment period closes, the SEC publishes all received letters to its public docket and begins the staff analysis phase. Proposals that attract a high volume of substantive comment letters, particularly those raising novel legal arguments or presenting data the agency has not addressed, tend to extend the rulemaking timeline before a final rule is adopted.

Hyperliquid's five recommendations, once available on the SEC's public comment docket, would represent the protocol's official legal and technical position on the proposal's deficiencies. Verification against that docket, accessible via the SEC's comment search tools, is the required step before any characterization of the five changes should be treated as confirmed reporting. No adoption timeline, SEC staff response, or rule modification has been confirmed as a result of the submission.
