Bitwise CIO Matt Hougan is making a counterintuitive case: the Senate's failure to pass landmark crypto legislation may have actually sped up the regulatory process, even if it left the industry without the durable legal framework it had been counting on.

The Vote That Stalled the Bill

On September 15, 2026, a cloture vote in the US Senate failed on the Digital Asset Market CLARITY Act.The failed cloture vote means the Senate failed to obtain the 60 votes needed to end a filibuster. The bill never reached the floor for a substantive vote on its provisions.
It failed over ethics language on officials' crypto holdings, not the SEC and CFTC market-structure framework the industry wanted. The Democrats who spent months negotiating the text, including Gillibrand, Warner, Booker, Warnock, Gallego, Alsobrooks and Cortez Masto, all voted no: the bloc that was supposed to deliver seven votes delivered none. Senator Thom Tillis later preserved a technical path for reconsideration by switching his vote to no for procedural reasons, meaning the bill is stalled rather than legally dead.

The SEC Moves Without Congress

Within days of the vote collapsing, the SEC acted on two fronts. On September 17, 2026, the SEC approved a temporary, conditional exemption, the Innovation Exemption, to allow limited trading of tokenized stocks on Tokenized Securities Venues (TSVs).TSVs would be allowed to operate permissioned automated market makers and liquidity pools without registering as national securities exchanges or alternative trading systems.
SEC Chairman Paul Atkins said the agency was taking "a significant step forward, within its statutory authority, to bring America's capital markets into the digital age" through the Innovation Exemption. The policy does not permit unrestricted tokenization of any U.S. stock: tokenized shares must grant investors the same voting and dividend rights as traditional shares, and price-tracking synthetic tokens do not qualify.
The SEC then issued additional crypto guidance on September 25, extending the agency's active rulemaking posture further into the quarter.
Hougan's read is nuanced. He argues that while the industry may have gained faster regulatory action in the near term, it lost the longer-term legislative certainty that only a statutory framework can provide. The vote removed durability, not clarity. A future Commission can withdraw agency rules. The failure essentially ends market structure legislative work in the Senate for 2026, meaning the regulatory path for crypto in the United States now runs almost entirely through the SEC and CFTC, at least for now.
