Strategy Executive Chairman Michael Saylor has outlined a policy framework built around five rights he says individuals and companies need over digital assets: the ability to create, issue, custody, transfer, and use them. He presented the proposal in a discussion with Bitcoin Policy Institute Managing Director Conner Brown at the Freedom Tech DC summit, held Sept. 22-23 at Washington's National Press Club.<img src="https://academy-public.coinmarketcap.com/optimized-uploads/5aa681fc9a554eaeac2595ed2286d67a.png">
Saylor <a target="_blank" rel="noopener noreferrer nofollow" href="https://x.com/saylor/article/2103834820413374912">argued </a>that artificial intelligence will let people and companies produce far more than they can today, which he said makes the ability to finance, own, and exchange assets more important, not less. He called for what he described as a bill of digital rights rather than a bill of restrictions.
<h2 id="header-1">Financing Millions of New Companies</h2>
The proposal centers on making it easier to raise capital using digital tokens. Saylor said policymakers should set clear issuance rules and disclosure requirements simple enough that entrepreneurs without large legal teams could use them, with an ambition of enabling 10 million new companies to raise capital through the technology.
He extended a similar argument to tokenized securities, saying investors holding tokenized stock should be able to move that asset between competing custodians and financing providers rather than being confined to a single platform. Saylor described<a target="_blank" rel="noopener noreferrer nofollow" href="https://coinmarketcap.com/academy/glossary/tokenize"> self-custody</a> as a source of leverage for investors even when they ultimately choose to use a custodian, since the ability to leave gives customers bargaining power over service and fees.
On banking, Saylor called for banks to be permitted to custody<a target="_blank" rel="noopener noreferrer nofollow" href="https://coinmarketcap.com/currencies/bitcoin/"> Bitcoin</a> (BTC) and extend credit against it, and for insurers to be able to add it to their balance sheets. He pointed to the Basel framework's 1,250% risk weight assigned to certain cryptoasset exposures as an example of capital treatment he believes regulators should revisit.

<h2 id="header-2">Reporting Rules Built for a Different Era</h2>
Saylor also addressed financial privacy, arguing that ordinary transactions below a meaningful threshold should not trigger routine government reporting. He cited the federal currency-transaction reporting rule, which requires reporting on cash transactions above $10,000 and has not changed since 1972. According to a 2024 Government Accountability Office estimate he referenced, that threshold would be roughly $72,880 if adjusted for inflation to 2023 dollars.
He proposed a separate exemption for small digital-asset purchases, arguing that a $20 or $200 cap on tax-free spending is too low for a family dinner or other routine purchases. Under current US tax rules, spending a digital asset can require calculating and reporting a gain or loss, which Saylor said discourages everyday use of the technology.
On compliance, Saylor proposed letting investors verify their identity once and reuse that credential across multiple financial providers, rather than repeating<a target="_blank" rel="noopener noreferrer nofollow" href="https://coinmarketcap.com/academy/glossary/kyc"> Know Your Customer</a> checks with each new counterparty. He said existing bank rules already permit limited reliance on another institution's identity verification, and argued that expanding this practice would lower onboarding costs without reducing providers' responsibility to monitor for suspicious activity.
Saylor also connected his proposal to artificial intelligence, arguing that AI agents will increasingly transact on behalf of individuals and companies and will need programmable, continuously available financial infrastructure that operates outside human working hours. He described<a target="_blank" rel="noopener noreferrer nofollow" href="https://coinmarketcap.com/currencies/bitcoin/"> Bitcoin</a> and other digital assets as suited to that role because they can move digitally at high speed, unlike physical assets.
He was critical of the CLARITY Act, the market-structure legislation that failed a Senate cloture vote earlier in September, saying it placed too much emphasis on restrictions rather than expanding what people can create, own, transfer, and use. Saylor said he expects the SEC, the CFTC, Treasury, and the White House to offer a more promising path toward his proposed framework over the next two years, and argued that widely used products can build durable public support for the industry in ways that legislation alone cannot. He said he believes digital assets can grow into a $100 trillion industry.
