The U.S. Senate has released a draft bill proposing a <a href="https://www.consumerfinancialserviceslawmonitor.com/2025/08/senate-banking-committee-releases-draft-digital-asset-market-structure-bill-and-request-for-information/" rel="noopener noreferrer nofollow">joint regulatory framework</a> for digital assets. This involves a formal committee shared by the SEC and CFTC, aiming to resolve jurisdictional disputes and create harmonized rules.
Key senators, including Tim Scott and Cynthia Lummis, are spearheading this initiative. It proposes placing digital assets under shared oversight, offered through public consultation until August 5, 2025.

The draft has far-reaching effects on market conduct and developer protections. ETH, BTC, and NFTs stand as the primary digital assets impacted, especially concerning how they're traded and classified.
This move could harmonize crypto regulation, ultimately impacting technology governance. Historical acts such as the <a href="https://www.morganlewis.com/pubs/2025/06/bipartisan-majorities-in-two-house-committees-vote-to-advance-the-digital-asset-market-clarity-act-of-2025" rel="noopener noreferrer nofollow">CLARITY Act</a> set precedence, marking a milestone in developer protection and rule harmonization.

The proposed joint committee mirrors efforts seen in the CLARITY Act (2025), which sought to balance SEC and CFTC roles. Such precursors provide context for anticipating future outcomes and developments.
Amanda Tuminelli of the DeFi Education Fund emphasizes the importance of strengthened developer protections. Amanda stated, "The new market structure draft from Senate Banking has the best developer protections language we have seen to date. Still digging into the rest of the bill, but this is worth celebrating immediately." This shift could lead to clearer guidelines, making compliance manageable for blockchain developers and protocol maintainers.
