Tonya Harding of Securities Regulations 
U.S. Representative Andy Barr led the charge, accusing Gensler of hamstringing <a href="https://news.todayq.com/gensler-blames-crypto-industry-for-noncompliance-downplays-the-need-for-crypto-regulation/">U.S. capital markets</a> with excessive red tape. Barr’s vivid comparison likened Gensler’s regulatory approach to the infamous Tonya Harding incident, underlining his apprehension regarding the growing regulatory burden.

Calls for Termination 
Representative Warren Davidson expressed his desire for the Biden administration to remove Gensler from his position. Davidson accused Gensler of promoting a “woke” political and social agenda and overstepping his role as SEC Chair. Davidson mentioned the SEC Stabilization Act he introduced, hinting that it could lead to Gensler’s removal.

However, when asked if Bitcoin qualifies as a commodity, Gensler evaded the question, stating that it falls outside the scope of U.S. securities laws. 
Representative Patrick McHenry accused Gensler of trying to hinder the <a href="https://news.todayq.com/us-lawmakers-demand-information-on-potential-de-banking-of-digital-asset-ecosystem/">digital asset ecosystem</a> and questioned the SEC’s transparency regarding its ties to FTX and its former CEO, Sam Bankman-Fried.

Representative Ritchie Torres probed Gensler about the nature of investment contracts, specifically asking whether buying a physical Pokemon trading card constitutes a securities transaction. Gensler initially expressed uncertainty but later clarified that it wouldn’t be considered a security when purchased in a store. However, when asked about tokenized Pokemon cards on digital exchanges, Gensler emphasized the significance of the Howey test.
