Subscription Services & Payment

The usage of CMC AI is based on the consumption of credits. In addition to free credits available to users, you may subscribe to one of our paid plans. The Subscription provides access to CMC AI credits, based on the plan selected, which will be made available to the account that is used to purchase the Subscription after the completion of payment.

You must have an account with CMC and comply with all the requirements applicable to CMC account holders/users in order to purchase and enjoy the Subscription. You must also authorize our payment processor to charge your chosen payment method for all fees associated with your Subscription. If our payment processor is unable to process your payment (e.g. credit card becomes invalid), we will cancel your Subscription without prior notice.

Changes, Cancellation & Refund

Subscriptions are billed on a recurring basis (monthly or annually) and subscription fees are prepaid at the start of each billing cycle. You may make changes to your subscribed plan at any time and the nature of the change would dictate when it will take effect (as explained below).

There are initially three types of subscription plans offered (i.e. Essential, Plus, Max). The types of plans and pricing may be updated from time to time.

If your change meets one of the two following criteria, the change will take effect after the end of the billing cycle of your current Subscription:

1. Switching your current Subscription to a different type of plan that costs less based on the actual monthly cost (e.g. from Max monthly plan to Plus yearly plan); OR
2. Switching your current Subscription to the same type of plan with a shorter billing cycle (e.g. from Essential yearly plan to Essential monthly plan).

If your change does not meet one of the above criteria, the change will take effect immediately to your Subscription and the subscription fees for the original plan and the new plan will be prorated in the current billing cycle. You will be refunded the subscription fees for the remaining days that are unused in the original plan on a pro rata basis in the form of payment credits. You will be charged the subscription fees for the remaining days to be used in the new plan on a pro rata basis, which you can pay for using the refunded payment credits. After that, you will be charged normally according to the new plan starting in the following billing cycle. As a result of this change, the credits allotted to you respectively in the original plan and the new plan will also be prorated.

For all types of plans, a cancellation of your Subscription will only take effect after the end of the current billing cycle. Unless required by law, we do not offer a refund of the subscription fees for any partial use or any cancellation before the end of the billing cycle.

Use & Restrictions

The Subscription may not be transferred to, or shared with, another account.

Your use of the Subscription services is subject to these Terms and all other terms and conditions on our Platform that are applicable to the use of CMC AI. You are responsible for observing and following any such terms and Disclaimers, whether contained in our Terms of Use or as announced and/or amended by CMC from time to time.

If we find that you have violated these Terms or you have misused or abused the services under your Subscription, or if required by law, CMC will unilaterally cancel your Subscription without prior notice or compensation.

Modification & Discretion

CMC may at its discretion modify, improve, suspend or discontinue the Subscription services (or any part thereof) from time to time, with or without notice. The Subscription plans may also be updated at any time, and we will inform you of the effective date of the implementation of any changes and how they may affect your existing Subscription in advance. Your continued use of the Subscription after the effective date of the changes will constitute acceptance of such changes.

CMC reserves all rights to amend, interpret and/or enforce these Terms, or to make any determination related to each Subscription and/or the services provided in relation thereto, at its sole discretion.

Limitation of Liability & Disclaimer

CMC is not responsible for any downtime, technical issues or interruptions caused by third-party providers which may occur to the services under your Subscription. In the event of such downtime, technical issues or interruptions, we will try our best to rectify the issue and resume service as soon as possible, but no compensation or refund will be available.

CMC makes no representation or warranty whatsoever regarding the Subscription services. The Subscription services are provided “AS IS” without warranties of any kind.

To the fullest extent permitted by law, CMC shall not be liable for any loss or damage (whether direct or indirect) which may result from any purchase or use of the Subscription, including (without limitation) any reliance on or expectation for the Subscription services or any part thereof.
