Crypto firms poured $233 million into U.S. political committees during the 2026 midterm cycle, according to Public Citizen’s analysis of federal filings. The money comes at a pivotal moment for digital-asset regulation: Democrats are set to take control of both chambers of Congress in January, reopening the political pathway for the stalled CLARITY Act, a bill intended to establish federal rules for crypto markets.
But the party shift alone may not be enough. Negotiations around ethics and conflicts of interest—areas where Democratic lawmakers have shown heightened scrutiny—have already been central to why the Senate failed to move the CLARITY Act in September. As additional scrutiny looms, industry stakeholders are likely to face tougher questions about consumer protections and the obligations that come with clearer rules.

Public Citizen’s analysis places crypto-related political contributions at $233 million for the 2026 midterm cycle. The same political environment also shaped individual races in ways that underline how contentious crypto has become in parts of the country.
In Ohio, Democrat and longtime crypto skeptic Sherrod Brown defeated Republican Sen. Jon Husted, despite reported spending by crypto-backed political action committees totaling $64 million aimed at defeating him. Meanwhile, Senator Elizabeth Warren—a prominent critic of crypto in Washington and the most senior Democrat on the Senate Banking Committee—has been reported as expected to chair that panel in the next Congress.
Together, these developments suggest that any push for crypto market-structure legislation will likely be tested against consumer-protection and governance concerns rather than treated as a pure deregulatory or rule-clarity exercise. In other words, a Democratic majority may shift the legislative tone: less about “getting to yes” quickly, more about demanding guardrails before moving forward.

Why ethics provisions derailed progress before

The Senate failed to advance the CLARITY Act in September, with disagreements over ethics provisions cited as a contributing factor to the impasse.
With Democrats now positioned to control both chambers starting in January, the debate appears ready for a redesign. Coverage cited that House Democrats may consider expanding proposals from Rep. Maxine Waters into a broader market-structure package. Such a bill, as described in the source reporting, could incorporate stronger consumer protections, a greater role for the Securities and Exchange Commission (SEC), and new restrictions on public officials’ crypto activities.
At the same time, the politics behind the ethics fight may be broader than the industry’s legislative priorities alone. Democratic outreach in the source notes plans to investigate the Trump family’s business dealings, alongside wider scrutiny themes connected to corruption and corporate interests.
Representative Shri Thanedar, who remains hopeful about CLARITY’s prospects, argued that any legislation must include stronger ethics requirements—specifically calling for provisions that apply to the President, not just Congress. His position frames the issue as a governance standard rather than a narrow procedural dispute.

The Binance hack adds urgency—and changes what “certainty” means

The midterm results arrived while lawmakers were dealing with fallout from what coverage described as the largest hack in crypto history: a Binance-linked wallet exploit reported as occurring on Oct. 29, with over $6.3 billion stolen.
According to the source, Sen. Thanedar said the legislation would not solve every potential problem, but could offer “much-needed certainty” and “security guardrails,” using the hack as a practical example of the risks associated with delayed regulation.
But other stakeholders argue the incident highlights gaps that market-structure legislation still may not address. Maylea Ma, deputy general counsel at 1inch, characterized the hack as involving a centralized exchange’s hot wallet and signing failure—and said the current CLARITY draft, as described in the reporting, lacks elements such as an insurer or loss payee, and does not cap hot wallet exposure in a way that could have mitigated the losses or imposed preventive security standards.
Amanda Fischer of Better Markets, as cited in the source, argued that the ecosystem is “unfit for purpose” for mainstream finance and that exchanges should not act as custodians because custody creates “honeypot risk.” The practical implication for lawmakers is that consumer protection is likely to be judged not only by regulatory permissions and classifications, but by whether the rules meaningfully reduce catastrophic-loss scenarios.
Ma also said the hack is likely to affect the next vote on CLARITY by making it harder for lawmakers to pass what the industry wants unless proposals include stronger consumer protections. That puts the burden on negotiations: translating political influence into legislative text that addresses security and custody realities, not just market definitions.

What the industry may have to accept to get a bill that survives

Even if Democrats advance the CLARITY Act—or a broader successor—the industry may face increased regulatory expectations to ensure the law endures across political shifts. Paul Brody, founder and CEO of Nightfall Networks and a former EY blockchain lead, suggested that banks could be positioned as “winners,” arguing they will press for crypto firms to meet the same consumer-protection and security standards.
Brody said the industry has opposed such an approach but argued that a better strategy may be to accept similar conditions, given blockchain ecosystems’ programmability and efficiency. His view boils down to a tradeoff: tighter requirements may cost flexibility in the short term, but could improve the odds of passing legislation that is stable enough to guide compliance going forward.
Lindsay Fraser, chief policy officer at the Blockchain Association, pushed back on the idea that consumer protection necessarily competes with innovation. She framed the goal as durable policy aligned with how technology works—something intended to earn public trust while allowing U.S. builders to plan for the future.
Still, uncertainty remains. Brody pointed to the possibility of a presidential veto, and emphasized that crypto may be a lower priority compared with investigations into corruption, budget battles, and major geopolitical issues—any of which could interrupt momentum for market-structure legislation.
That tension matters for readers tracking the next steps: “Democratic control” may reopen the legislative door, but it doesn’t guarantee a path through committee timelines, floor votes, executive review, or the content disputes that have already halted progress once.
As January approaches, the key question is not whether crypto will regain legislative attention, but what conditions lawmakers will attach—especially around ethics rules and consumer-security standards—and whether the industry is prepared to adjust its position quickly enough to meet those demands before the political window closes.
