Bloomberg Government’s November 4 preview of the new committee lineup names Elizabeth Warren as the incoming Senate Banking chair and lists Trump’s crypto deals among the Democrats’ investigation targets. Duke University’s Lee Reiners gave CNBC the other half of the picture: crypto platforms keep their current products and still answer to “friendly regulators at the SEC and CFTC.”

An Approval Issued on Election Day

On November 3, CFTC Chairman Michael Selig announced that perpetual futures on individual stocks can begin trading on CFTC-registered exchanges. Only exchanges that are also notice-registered with the SEC to trade security futures qualify. Security futures are futures on single stocks, a product class the two agencies supervise jointly, so the approval carries an SEC component as well as a CFTC one.

Selig presented the move as a way to keep American traders away from “offshore, and often unregulated, venues.” Warren answered the same day, accusing Trump’s CFTC in a written statement of “rubber stamping 24/7 high-stakes gambling on our stock market.” Her objection rests on timing: the contracts trade around the clock on stocks that trade only during market hours, a gap she argued invites insider trading and volatility.

The decision also came from a commission of one. Selig has been the CFTC’s only sitting commissioner since December 2025. In April he told lawmakers the agency would not pause rulemaking while waiting for Trump to fill the other four seats, Bloomberg Government reported. Senate Agriculture’s nominations record shows no CFTC commissioner nominee referred since Selig’s confirmation on December 18, 2025.

Warren’s future gavel does not reach Selig directly. The CFTC answers to the Agriculture committees. In the Senate, the Commodities, Derivatives, Risk Management, and Trade subcommittee lists the agency and covers derivatives and digital assets. Banking’s route into the stock-perps decision runs through the SEC registration requirement, since Banking oversees the SEC. A Banking hearing on the product would question the SEC side of the arrangement, while Selig’s own reasoning is a matter for Agriculture.

Coindoo has already covered the trading terms for U.S. stock perps. The oversight question is how the CFTC weighed the risks Warren names before opening the route.

World Liberty Is Where Oversight Meets the Stalled Bill

Warren’s office describes World Liberty Financial as the Trump family crypto company. Her September 15 letter to Treasury Secretary Scott Bessent and Attorney General Todd Blanche was her third request for an investigation, after letters in November 2025 and May 2026.

Each letter built on press reports:

The first cited reported token sales to buyers linked to North Korean state-sponsored hackers and sanctioned Russian money-laundering entities.

The second cited a reported partnership with a venture whose flagship project had been led by people the administration itself sanctioned.

The third cited a New York Times report that a British businessman under a UK money-laundering investigation spent $100 million on WLF tokens through a firm called Aqua 1.

Warren also pointed out that WLF has preliminarily obtained a national trust bank charter. Every item is a reported allegation relayed by a senator, not an agency finding.

The September letter set a September 29 deadline and asked both agencies to answer Warren’s earlier inquiries too. It also tied the request to legislation. Warren argued that the market-structure bill then heading for a Senate vote would let the president keep profiting from his crypto ventures.

The ethics question is the thread connecting the letters to the bill. Bloomberg Government reports that the CLARITY effort collapsed when senators and the White House could not agree on ethics language that would have undone Trump’s personal crypto ventures. Warren has been raising that same subject with Treasury and DOJ for a year. Coindoo’s look at CLARITY’s narrower path to 60 votes covers the vote math.

January changes the instrument. A minority member can only ask executive agencies to investigate. A chair can call witnesses and demand records. Treasury and DOJ can still answer with executive-privilege claims, and a disputed demand can turn into a drawn-out enforcement fight.

What a Gavel Adds, Tool by Tool

Committees can investigate when they hold delegated authority, jurisdiction over the subject and a valid legislative purpose, according to the Congressional Research Service. Here is how each tool applies to the two files.

Funding bills

Both agencies’ budgets move through appropriations, which still need 60 Senate votes and a presidential signature.

Subpoena rules separate the two chambers. Under the rules Senate Banking adopted in 2021, the last time Democrats chaired it, a witness subpoena needed the ranking member’s agreement or a majority committee vote. A Democratic majority on the panel can supply that vote, but each demand then becomes a recorded committee decision.

The House Financial Services rules now in force delegate subpoena power to the chair, with 48 hours’ written notice to the ranking member. Both committees adopt fresh rules when the new Congress organizes.

On the House side, Bloomberg Government names Maxine Waters as the likely Financial Services chair. Sean Casten is challenging her for the post, and French Hill moves to ranking member. Banking’s website still lists Tim Scott as chair and Warren as ranking member until the Senate reorganizes.

What the Majority Cannot Undo

None of these tools rewrites an agency’s authority. Changing statutory powers or imposing binding restrictions generally takes legislation passed by both chambers and presented to the president, as the CRS account of congressional control over agencies explains. The stock-perps route stays open unless the CFTC withdraws it or a law closes it.

The majority is also less uniform than the Warren-versus-Selig exchange suggests. In July 2025, 78 House Democrats voted for CLARITY despite Waters’ opposition. The Senate shift runs the other way. Sherrod Brown, Banking’s chair until 2025, returns after beating Jon Husted despite millions of dollars in pro-crypto spending against him. Bloomberg Government expects him to return without the seniority for a top gavel.

Signals Between Now and the First Gavel

The test is whether statements turn into documents. These dates and filings will show it either way.

December 11: Current government funding expires, per Bloomberg Government. The deal that follows sets SEC and CFTC budgets before Democrats hold the appropriations gavels.

Before adjournment: A CFTC nomination sent to the outgoing Senate goes to a Republican-led Agriculture Committee. One sent after the new Congress organizes goes to a Democratic-led panel.

January 3: This is the constitutional default for convening unless a law sets another day. In 2027 it falls on a Sunday, so a statute moving the date is the first item to watch.

Committee organization: The published 2027 rules for Banking and Financial Services will show who can authorize a subpoena.

First notices: A hearing notice, document request or subpoena naming equity perps or World Liberty.

The opposite signal is just as specific: a first quarter of 2027 in which Banking and Agriculture schedule crypto hearings on market-structure bills alone, with no notice or demand touching either file.
