Election Day has arrived in the US with cryptocurrency regulation—and the politics surrounding it—set to take center stage as Americans vote in the 2026 midterms. The results in the House (all 435 seats) and the Senate (35 seats) will determine whether President-elect Donald Trump’s Republican allies can push their agenda during the final two years of his term.
Republicans currently hold control of both chambers, with 53 Senate seats versus 45 held by Democrats and two independents who caucus with them, alongside a narrow advantage in the House. To flip the Senate, Democrats would need a net gain of four seats; to take the House, they would need a net gain of three seats. The outcome could also reshape the near-term trajectory of pending digital-asset legislation, including the stalled CLARITY Act, and may trigger renewed scrutiny of Trump-linked crypto business interests if Democrats gain power—following a Reuters report that Democratic lawmakers are preparing further investigations into potential conflicts of interest involving members of the president’s family.

Coin-focused political spending has intensified across the 2026 election cycle, with Reuters reporting roughly $176 million deployed by crypto industry groups across more than 100 races. At the center of the activity is Fairshake, backed by Coinbase, Ripple, and Andreessen Horowitz, which has spent through affiliated super PACs including Defend American Jobs and Protect Progress.
In early October, Fairshake announced support for 32 incumbent House candidates—including 19 Republicans and 13 Democrats—all of whom had voted in favor of the CLARITY Act in 2025, according to a Cointelegraph report (Crypto PAC Fairshake house endorsements for US midterms). The message was clear: crypto-aligned donors are tying financial support to specific legislative behavior, not just general pro-industry branding.
Other groups also feature prominently. The Digital Freedom Fund, backed by Tyler and Cameron Winklevoss (Gemini co-founders), and Fellowship PAC, which has supported candidates from both parties, have added to the competitive pressure across targeted districts and states. The overall pattern suggests the industry is preparing for a post-election policy push—regardless of party dominance—while trying to ensure that lawmakers most receptive to its policy goals are in office.

Races where crypto policy may decide the outcome

The Blockchain Association’s election dashboard highlights dozens of “priority” contests, identifying 61 congressional races (including 18 Senate and 43 House seats) based on competitiveness, candidates’ crypto positions, and committee roles relevant to digital-asset legislation. That list underscores that crypto spending is not spread evenly; it clusters where legislative influence can be translated into committee power or agenda-setting momentum.

Ohio Senate: a clash featuring a longtime crypto critic

One of the most closely watched contests pits Republican Senator Jon Husted against Democrat Sherrod Brown. Coverage indicates about $63 million in crypto-related spending has been directed to the race, including roughly $56 million from Fairshake, with an additional $7 million attributed to the Winklevoss-backed Digital Freedom Fund, as outlined in Cointelegraph’s reporting (Fairshake spending in Ohio Senate race).
Stand With Crypto characterizes Brown as strongly opposed to cryptocurrency, pointing to 17 statements and his 2024 vote against overturning the SEC’s SAB 121 guidance on crypto custody accounting. The stakes are also heightened by the fact that Brown previously faced heavy crypto PAC spending in 2024, when Fairshake affiliate Defend American Jobs spent more than $40 million to support Republican Bernie Moreno, who ultimately defeated Brown, as described in earlier Cointelegraph coverage (Sherrod Brown’s crypto PAC race in Ohio).

Nebraska Senate: incumbent support and a committee-linked policy record

In Nebraska, Republican Senator Pete Ricketts faces independent challenger Dan Osborn. A Washington Examiner report cited in the source coverage says Fairshake had spent nearly $11 million supporting Ricketts as of Oct. 27 (Washington Examiner: crypto spending tops $10 million in Nebraska Senate). More recent totals compiled by Bankrolled, using Federal Election Commission data, place Defend American Jobs at roughly $13.5 million opposing Osborn as of Nov. 3 (Bankrolled Nebraska Senate page).
Ricketts serves on the Senate Banking Committee. Stand With Crypto contends he has supported major digital-asset legislation, including the CLARITY Act and the GENIUS Act. The source also points to Ricketts voting to advance the CLARITY Act out of committee in May and supporting an unsuccessful Senate procedural move in September, with details linked to his official press release (Ricketts press release on CLARITY Act advance), and additional advocacy context from Stand With Crypto’s profile (Stand With Crypto profile: Pete Ricketts).

Texas Senate: both sides cite “clarity,” but advocacy ratings differ

Texas is another key matchup, with Republican Ken Paxton facing Democrat James Talarico. The Winklevoss-backed Digital Freedom Fund is listed as supporting Paxton, despite both candidates receiving A ratings from Stand With Crypto, according to the source.
Paxton has called for the CLARITY Act and argues that clearer rules are needed to keep the US competitive in digital assets. His campaign statement describes an effort to make the US the “crypto capital of the world” and to support innovation and growth, as linked in the source (Ken Paxton website). Talarico, by contrast, has emphasized consumer protection alongside innovation in his call for clear regulatory standards and—per the cited legislative record—voted in 2025 to establish a state strategic Bitcoin reserve. That legislative reference is included via a link to the Texas House journal page cited in the source coverage (Texas House journal reference), with Stand With Crypto providing additional context.

Wyoming Senate: continuity after Cynthia Lummis

Wyoming’s race stands out because it involves an open seat being filled after Senator Cynthia Lummis—a prominent crypto advocate—decided not to seek reelection. Lummis chairs the Senate Banking Subcommittee on Digital Assets and sponsored the BITCOIN Act of 2025, which the source links to a proposal for a US strategic Bitcoin reserve. She has also supported the CLARITY Act and GENIUS Acts, as described in earlier Cointelegraph reporting (Cynthia Lummis coverage; BITCOIN Act coverage).
The candidates are Republican Harriet Hageman and Democrat James Byrd. The source states Hageman supported the CLARITY and GENIUS Acts in 2025 and the FIT21 market structure bill in 2024, and that she co-sponsored legislation aimed at restricting the Federal Reserve from issuing a central bank digital currency. By contrast, Stand With Crypto’s listing reportedly shows no documented crypto position for Byrd, according to the source.

Maine Senate: from opposing CLARITY to defending a seat

In Maine, Senator Susan Collins—noted in the source as one of four Republicans to oppose advancing the CLARITY Act in September over concerns related to bank deposits—now faces Democrat Troy Jackson to defend her seat. The contrast is that Jackson, per Stand With Crypto, has called for ending “debanking” of lawful crypto businesses and ensuring the right to self-custody digital assets, as reflected in his advocacy rating and profile (Stand With Crypto profile: Troy Jackson).

Why investors and builders should track the vote results

Even before any winners are fully confirmed, the structure of the races points to a practical reality: US digital-asset policy often moves through committee leadership and legislative alignment rather than broad campaign rhetoric. If Democrats win enough seats to take control of one or both chambers, they could influence whether bills like the CLARITY Act regain momentum—or whether new oversight battles take priority. Separately, Reuters’ earlier reporting that Democrats are preparing additional investigations into potential conflicts tied to Trump family business dealings adds another variable that could shape how quickly the political system turns toward crypto-specific legislation.
As results come in, readers should watch not only who wins, but whether key committees and the legislative calendar tilt toward accelerating stalled digital-asset proposals—or toward further investigations and delays that can complicate any near-term regulatory clarity.
