The U.S. Securities and Exchange Commission will continue accepting public comments on its cryptocurrency regulatory proposal even after the official comment deadline has passed, extending the window for crypto firms, investors, and legal advocates to place their concerns on the formal record. The decision keeps the public-input phase of the rulemaking process open and signals that the agency is treating the comment record as an active, evolving document rather than a closed file.
Federal rulemaking at the SEC is governed by the Administrative Procedure Act, which requires agencies to consider public comments before finalizing a rule. Accepting submissions after a stated deadline does not obligate the commission to alter or withdraw its proposal, but it does expand the evidentiary record that staff and commissioners must weigh before any final action is taken. For Bitcoin holders and crypto market participants, the procedural move matters beyond the immediate proposal text. Regulatory clarity, or the absence of it, directly affects how custodians structure holdings, how exchanges operate order books, and whether institutional capital flows into the asset class. The SEC's posture on crypto has drawn sustained attention following its safe harbor discussions; Ripple's chief legal officer publicly praised the SEC's crypto safe harbor proposal as a constructive step toward workable rules.

Who Can Still Submit Comments and How

The continued acceptance of comments means any interested party, including individual investors, crypto exchanges, law firms, trade associations, and protocol developers, can submit written input to the SEC directly through its public comment portal at SEC.gov. Submissions become part of the public record and are typically posted online, making them visible to other commenters, litigants, and Congress.
Comments carry the most weight when they address specific provisions of the proposal with technical, legal, or market-impact arguments. Generic opposition or support without substantive reasoning receives less consideration during staff review. For Bitcoin-native businesses and custodians, this is an opportunity to address how proposed rules interact with proof-of-work mining economics, self-custody rights, and the settlement finality properties that distinguish Bitcoin from securities.
The parallel regulatory track at the CFTC adds further complexity. The CFTC's proposed Reg CM framework would allow crypto exchanges to seek direct federal oversight, creating a potential jurisdictional overlap that commenters addressing the SEC proposal may want to flag explicitly in their submissions.

Public comment periods in major rulemaking actions often generate thousands of submissions. A longer effective window increases the likelihood that technically sophisticated responses, those requiring coordination among legal teams, compliance officers, and engineers, make it into the record before staff drafts a final rule. For a sector where protocol-level details are inseparable from legal classification questions, that depth matters.
SEC Commissioner Hester Peirce has previously argued that moving assets onchain does not by itself change their legal character under securities law. Peirce stated that crypto vaults cannot avoid securities law simply by moving onchain, a position that informs the broader framework the commission is developing and one that commenters may directly engage with in their submissions.
The CFTC has also moved aggressively on crypto jurisdiction. The CFTC sent draft crypto market rules to the White House earlier this year, compressing the timeline for interagency coordination. Comments filed with the SEC that acknowledge CFTC activity are more likely to surface issues that require cross-agency resolution, which could influence the final rule's scope.

The next concrete signal to monitor is an SEC notice clarifying how late-filed comments will be handled, whether they will be treated identically to timely submissions or flagged separately in the record. A notice of that kind would appear in the Federal Register and on the SEC's rulemaking docket page at SEC.gov.
Beyond procedural notices, watch for the volume and character of published comments. A high volume of technically detailed submissions from institutional actors typically precedes a longer deliberation period before the commission issues a final rule or a revised proposal. Conversely, sparse or low-quality comment records have historically accelerated final action.
Any proposed revision to the rule text, a supplemental notice of proposed rulemaking, would restart the comment clock entirely and represent a significant development for market participants tracking this process. A final rule, by contrast, would be subject to judicial challenge under the APA, and the strength of the comment record is central to how courts evaluate whether the agency's reasoning was adequate.
Bitcoin's network operates independently of any single regulatory outcome. Hashrate, difficulty adjustments, and the block subsidy schedule are indifferent to SEC rulemaking timelines. But the legal environment surrounding Bitcoin-denominated businesses, exchanges, ETF structures, and custodians is shaped by exactly the kind of regulatory record being built through this comment process. Participants with a stake in the outcome have a concrete, open channel to influence that record while the SEC continues accepting input.
