Australia has laid out the ground rules for crypto. On October 15, ASIC published proposed operating standards that give exchanges and custody providers their clearest look yet at what compliance will actually cost starting in April 2027. Under the new setup, platforms will need dedicated financial services licenses, alongside strict regulations around client asset protection, trade execution, and conflicts of interest.
There is, however, still some friction regarding capital requirements. If a platform holds customer assets directly, ASIC may require up to A$14 million in net tangible assets. Those that do use qualifying custodians face a much softer floor of A$200,000. That difference is huge, and it will force most exchanges to rethink their entire infrastructure before they even file an application.
It’s a fast timeline; the consultation period ends November 27, final standards arrive in March 2027, and existing platforms have until October 7, 2027, to submit applications while remaining operational.
An underlying problem is the fact that ASIC is already behind, currently sitting on a backlog of over 140 applications from previous filing rounds, with more than 110 carried over from a period of temporary relief. Throwing high capital floors and tight deadlines on top of an already clogged system means small players are going to struggle to get through the queue, while well-funded platforms get an immediate structural advantage.
