Kalshi is having a landmark week. New data show prediction-market trading volumes shattering previous records in the third quarter of 2026, Morgan Stanley has stepped into a formal role at a major industry summit, and a federal appeals court has issued a ruling that adds fresh uncertainty to how Kalshi's sports contracts will be regulated.
Together, these three developments capture where the prediction-market industry stands right now: growing fast, attracting serious financial institutions, and still without a settled legal framework.

According to data from CryptoRank, prediction-market transaction counts topped one billion for the first time in Q3 2026, landing at roughly 1.1 billion a new all-time high.
That figure is more than double the approximately 490 million transactions recorded in Q1 2026, and a sizable jump from Q2's roughly 709 million. Just a year earlier, in Q4 2025, the entire market processed around 137 million transactions.

It's worth noting this measures trade count, not dollar-denominated trading volume — a high transaction number reflects activity and engagement rather than the total value changing hands.

Why Kalshi Is Driving Prediction Market Growth

CryptoRank credited Kalshi specifically as the platform behind most of Q3's new transactions, further extending its lead over rivals in raw trade count.
That said, transaction volume is only one measure of a platform's health it doesn't directly capture liquidity, active user counts, or valuation. The bigger question looming over the sector is whether this trading activity can broaden beyond its current base into new kinds of use cases.

Morgan Stanley Joins NEXTPredict as Institutional Interest Grows

Morgan Stanley has become a strategic partner of NEXTPredict, a prediction-markets summit taking place in New York on October 22–23, and will lead a panel focused on institutional capital.
Stephen Grambling, the bank's head of U.S. gaming, lodging and leisure research, will moderate the session, which is expected to cover market structure, risk, and the barriers keeping large institutions on the sidelines, alongside the opportunities prediction markets could offer them.
This isn't Morgan Stanley's first involvement with Kalshi. The bank took part in Kalshi's $1 billion Series F round in May 2026, which valued the exchange at $22 billion at the time. Its research arm, Counterpoint Global, has since studied more than 72 million Kalshi trades to assess forecasting accuracy.

Prediction Markets Face Questions Over Sports-Heavy Activity and Institutional Adoption

Industry figures have pointed out that roughly 90% of current prediction-market liquidity and turnover comes from sports contracts, with many users treating these platforms as an alternative to traditional sportsbooks.
For institutional players, the appeal lies elsewhere in forecasting accuracy, hedging exposures that can't easily be covered through existing instruments, and using market-based pricing as an information source.
Banks reportedly remain cautious, waiting for clearer crypto regulation before committing further. These remain industry perspectives on where the space could head, not confirmed outcomes.

Sixth Circuit Rules Kalshi Sports Contracts Are Not Swaps

A three-judge panel on the U.S. Court of Appeals for the Sixth Circuit ruled that Kalshi's sports event contracts don't qualify as swaps under federal commodities law, meaning they fall outside the CFTC's exclusive regulatory reach and instead sit under state-level gambling oversight.
The decision arose from two lawsuits Kalshi filed against regulators in Ohio and Tennessee; the court affirmed Kalshi's standing to sue but disagreed that its sports contracts amount to federally regulated swaps.
This adds to an already fractured legal picture: the Third Circuit previously upheld CFTC jurisdiction over prediction markets, while the Eighth Circuit found sports contracts aren't swaps, aligning with the Sixth Circuit but at odds with the Third.
With appellate courts split, the underlying dispute is now headed to the U.S. Supreme Court, and no single ruling should be treated as the nationwide standard yet.

What the Latest Kalshi Developments Mean for Prediction Markets

Taken together, these three threads show an industry expanding on multiple fronts at once: record trading activity, growing interest from major financial institutions, and regulatory questions that remain far from resolved. None of this guarantees where the sector goes next — it simply reflects where things stand today.

Conclusion

Q3 2026 marked a genuine milestone for prediction markets, with transactions crossing 1.1 billion and Kalshi named as the primary driver of that growth.
At the same time, Morgan Stanley's move into NEXTPredict signals real institutional curiosity, even as the Sixth Circuit's ruling underscores how unsettled the legal landscape remains.
For an crypto news market with valuations built partly on the assumption of institutional adoption, regulatory clarity will likely stay one of the most important storylines to watch.
