The chair of the Commodity Futures Trading Commission says the agency intends to move forward with crypto market rules regardless of whether Congress passes the CLARITY Act, signaling that regulators do not view the pending legislation as a precondition for progress on digital-asset oversight.

Agency action, not legislation, is driving the timetable

The core of the message is a separation between two tracks: rulemaking by the CFTC and the passage of a market-structure bill by Congress. The chair framed crypto market rules as something the agency can advance on its own authority, according to remarks published by the CFTC. For related coverage, see Crypto News March 26: Morgan Stanley Bitcoin ETF Imminent, CFTC Bringing Perpetuals Home, CLARITY Act Hammers Circle and Coinbase.

That distinction matters because it treats the CLARITY Act as one input into the policy backdrop rather than the switch that turns rulemaking on or off. The statement should be read as a signal of intent and process, not as evidence that final rules already exist.

Readers should not overstate what has been settled. The remark describes a direction of travel; it does not confirm adopted rules, effective dates, or the specific scope of any proposal.

Why moving ahead without the CLARITY Act matters for crypto firms

For exchanges, token issuers, and other crypto businesses, the practical takeaway is that regulatory clarity can emerge from agency action as well as from legislation. That shifts where market participants look for the next signal, toward the CFTC and not only toward lawmakers.

The idea that a bill's fate need not gate rulemaking echoes analysis that a stalled CLARITY Act could actually push the SEC and CFTC to accelerate their own rules. The chair's comment fits that framing: an independent regulatory path changes how the industry reads policy momentum.

The counterpoint is that legislation still carries weight. Industry voices have described a Senate breakthrough on the CLARITY Act as a potential watershed moment for crypto, a reminder that agency rules and a statute are not interchangeable even if they can proceed on separate timelines.

What to watch next from the CFTC and Washington

The next concrete milestones to monitor are official CFTC steps: proposed rules, comment periods, and public statements that flesh out how the agency intends to regulate crypto markets. Those are the process markers that would turn stated intent into enforceable policy.

Coordination between agencies is also part of the backdrop. The SEC and CFTC have announced a memorandum of understanding between the two regulators, underscoring that market oversight is being shaped by cooperating agencies, not a single bill.

The chair, Michael Selig, has separately argued that existing financial systems are outdated and has pointed to blockchain's potential to modernize finance, context that helps explain why the CFTC is positioning itself to act rather than wait.

The disciplined way to follow this story is to track official proposals and statements as they appear, while keeping the CLARITY Act in view as a still-relevant part of the policy environment rather than the sole driver of it.
