Senator Cynthia Lummis (@SenLummis) is making her case plain: the United States must pass the CLARITY Act now or risk ceding the future of global finance to rival nations.
Speaking publicly in recent weeks, the Wyoming Republican framed the legislation not merely as a regulatory exercise but as an economic imperative. Lummis argued that China is not waiting, and tied the CLARITY Act directly to America's dollar-dominated financial leadership. Her warning is pointed: if Washington fails to set digital asset standards, other countries will do it instead.

What the CLARITY Act Would Do

Senator Lummis says the CLARITY Act is designed to end the regulatory ambiguity that has dogged American crypto consumers and the digital asset industry for years by clearly defining how tokens and market participants are treated under United States law.The bill is designed to formally divide responsibilities between the SEC and the CFTC, giving the SEC oversight of digital asset securities while expanding the CFTC's authority over digital commodity spot markets.
Right now, both the SEC and the CFTC claim authority over crypto, and the two agencies have taken overlapping positions on digital assets for years, with the SEC arguing that many tokens function as securities while the CFTC has pushed for a larger role overseeing commodity-style crypto markets. In practice, that overlap has often left exchanges and trading platforms facing competing interpretations and potentially duplicative compliance obligations.

A Rare Legislative Window

The House passed the Digital Asset Market Clarity Act in July 2025 by a 294-134 vote, and on May 14, 2026, the Senate Banking Committee advanced an amended version in a bipartisan 15-9 vote. The bill still requires approval from the full Senate, where it must clear the 60-vote filibuster threshold, before any final reconciliation with the House version and a signature from President Donald Trump.
Lummis is warning that failure to act could delay comprehensive digital asset legislation until 2030, arguing that inaction would leave developers without legal protections, consumers vulnerable, and law enforcement without stronger tools to pursue bad actors. She urged Congress to send the bipartisan bill to Trump, arguing it could help make the United States the crypto capital of the world.
Lummis described the latest compromise language as "the culmination of months of hard work," adding that lawmakers were "closer than ever to getting the CLARITY Act across the finish line."
