Elon Musk’s artificial intelligence company, xAI, is operating nearly 50 natural gas turbines at its data center in Mississippi without state air pollution permits, according to a lawsuit filed by the NAACP. The turbines, mounted on flatbed trailers, are classified as ‘mobile’ under state law, allowing them to bypass emissions regulations for up to one year. The NAACP is now seeking a court injunction to halt the operations, citing worsening air quality in an already polluted region.

Loophole Allows Unchecked Emissions

The turbines power xAI’s rapidly expanding data center in rural Mississippi, which supports the company’s AI training workloads. Under Mississippi state regulations, power plants mounted on trailers are considered mobile sources and are exempt from air pollution permitting requirements for the first year of operation. This classification has allowed xAI to install and operate 46 turbines without emissions controls or monitoring, according to local news reports.

The Southern Environmental Law Center, representing the NAACP, argues that this interpretation violates federal law. Under the Clean Air Act, power plants mounted on trailers can still be classified as stationary sources if they remain at a single location for extended periods. The lawsuit contends that xAI’s turbines are effectively permanent installations, despite being on wheels.

Legal Challenge and Community Impact

The NAACP filed its lawsuit on behalf of residents living near the data center, who report increased respiratory issues and a visible haze in the area. This week, the organization asked the court for an emergency injunction to shut down the turbines until proper permits are obtained.

Mississippi has granted permits for only 15 of the 46 turbines currently in operation. A press release from the Greater Memphis Chamber of Commerce in May 2025 stated that ‘about half’ of the 35 turbines then in operation would remain on site permanently. Since then, xAI has continued to install additional units, escalating the conflict.

Why This Matters for AI Infrastructure

The dispute highlights a growing tension between the rapid expansion of AI data centers and environmental regulations. As companies like xAI, OpenAI, and Google race to build massive computing clusters, the energy demands are straining local power grids and raising emissions concerns. Mississippi’s regulatory loophole could become a test case for how states balance economic development with public health protections.

For residents, the issue is immediate. The region already suffers from poor air quality due to industrial activity and proximity to major highways. The addition of dozens of unregulated gas turbines, each capable of running continuously, threatens to push pollution levels higher.

Conclusion

The NAACP’s injunction request sets the stage for a legal battle that could define how data center emissions are regulated in the United States. If the court rules that xAI’s turbines are stationary sources, it could force the company to apply for permits and install pollution controls. For now, the turbines continue to run, and the community waits for a decision that will affect their air and health.

FAQs

Q1: Why are the gas turbines considered ‘mobile’?
Under Mississippi state law, power plants mounted on flatbed trailers are classified as mobile sources, exempting them from air pollution permitting for one year. This classification is being challenged in court.

Q2: How many turbines is xAI operating?
As of May 2026, xAI is operating 46 natural gas turbines at its Mississippi data center. Only 15 have received permits.

Q3: What is the NAACP asking the court to do?
The NAACP is seeking an injunction to halt the operation of the turbines until xAI obtains proper air pollution permits and installs emissions controls.
