If you are planning to travel to Hong Kong in the next couple of days, you might want to see this.
The Hong Kong government recently introduced updated implementation rules under its national security framework to strengthen enforcement capabilities.
These changes, effective immediately, expand the powers of law enforcement agencies when handling cases related to national security.
Officials say the move is part of a broader effort to “continuously and effectively prevent, suppress, and impose punishment” for activities deemed a threat.
The amendments build on rules first introduced in 2020 and reflect lessons learned from past enforcement cases.

The updated rules give authorities greater flexibility and clearer procedures in investigating national security-related offenses.
This includes enhanced legal tools, clarified technical processes and expanded enforcement mechanisms.
As per the updated rules, authorities in Hong Kong now have expanded powers over electronic devices in national security investigations, including the ability to compel individuals to provide passwords or decryption assistance.
Under the updated rules, police can require a “specified person," broadly defined to include anyone who owns, uses, controls, or has access to a device, or even knows its password, to unlock or help access electronic equipment.
Refusing to comply is now a criminal offence, punishable by a fine of up to 100,000 HKD ($12,777.40 approx.) and up to one year in prison.
Authorities argue these updates will help them respond more effectively to risks that may arise “suddenly and unexpectedly” in an increasingly volatile geopolitical environment.
The official gazette also pointed out that judicial oversight remains in place, with courts "playing the gatekeeping role" for certain enforcement actions. Officials maintain that lawful rights and protections will continue to be respected under the Basic Law.
The Basic Law is Hong Kong’s mini-constitution, which was enacted by China in 1990 and came into effect in 1997 when Hong Kong was handed over from the United Kingdom to China.
It governs how Hong Kong operates under the principle of “one country, two systems.”

Why US travelers should pay attention

The update can directly affect American citizens traveling to the country.
As per Hong Kong's Tourism Board data, close to 1.5 million people travelled to the country from the Americas, which includes both North and South America, in 2025 alone.
Now, the scope of these new powers is wide. It covers devices such as phones, laptops and other digital storage tools, and potentially extends to encrypted systems like crypto wallets.
Authorities are also empowered to access, search, decrypt, copy, and transfer data, as well as seize and retain devices and any materials obtained from them.
These rules apply to anyone within Hong Kong’s jurisdiction, not just residents but also visitors and transit passengers. This means even travelers with layovers in Hong Kong could be subject to these requirements if implicated in an investigation.
At the same time, officials insist the rules “will not affect the lives of the general public” or normal business operations.
