According to the senator John Kennedy, the senate is moving toward a significant crypto regulation ruling next week. The CLARITY Act will be voted in on January 16, 2026. Legislators are planning to move forward despite the number of policy conflicts that are still unaddressed. The relocation indicates mounting pressures to clarify federal regulation of the markets of digital assets.

The planned markup places the Senate on a tight clock. The House already passed its version of crypto market legislation in July 2025. As a result, the Senate now carries responsibility for advancing the issue or risking legislative collapse. Additionally, The Senate Banking Committee approved the GENIUS Act moving it closer to a full Senate vote for stablecoin regulations.

Committee Advances Bill Amid Ongoing Disputes

Senators reopened talks this week after negotiations stalled last year. Members met privately to reassess the bill’s framework. However, those discussions did not produce full agreement. Even so, committee leadership decided not to delay the process further.

The CLARITY act attempts to separate regulatory power between the Commodity Futures Trading Commission and the Securities and Exchange Commission. The bill provides the CFTC with the primary supervision over crypto spot markets. Meanwhile, the SEC would regulate digital assets that are considered to be securities.

Some lawmakers argue the framework offers long-needed clarity. Others believe the language leaves too much room for future enforcement conflicts. These concerns remain unresolved heading into the markup.

Stablecoin Yield and DeFi Oversight Remain Contentious

Stablecoin regulation continues to divide lawmakers and industry groups. Yield-bearing stablecoins sit at the center of the dispute. Banking entities claim that interest payment might make the stablecoins deposit like products.

Even Democratic legislators have advocated tougher decentralized financial controls. They demand more effective anti-money laundering standards of DeFi-based platforms. In addition, they want clearer rules on whether certain tokens fall under securities laws.

Republicans have resisted those efforts. They argue that heavy restrictions could limit competition and push crypto activity offshore. As a result, stablecoin yield limits and DeFi compliance remain unsettled.

Ethics Questions Complicate the Legislative Path

Ethics provisions have added further tension to the bill. Lawmakers continue to scrutinize crypto ventures tied to President Donald Trump. These include World Liberty Financial and a Trump-affiliated memecoin.

World Liberty Financial operates as a decentralized finance platform. Public reports indicate the Trump family receives most net proceeds from token sales. By late 2025, profits reportedly reached significant levels, while large token holdings remained unsold. Moreover, the Trump family wealth jumped $1.3 billion after crypto firms ABTC and WLFI made their public market debut in September.

The platform has also drawn attention due to foreign investments. Some investors had previous criminal investigations or convictions. These issues have driven calls for rules limiting crypto profits by senior government officials.

Political Deadlines Increase Pressure to Act

The Senate is now under the strain of time. Another federal funding deadline on January 30 increases the chances of another government shutdown. This kind of shutdown would stop crypto-legislation advancement.

The bill must also advance by April to remain viable in 2026. The upcoming midterm elections further limit the window for action. Lawmakers may avoid prolonged negotiations as campaigns approach.

Industry groups estimate a moderate chance of passage this year. If enacted, the CLARITY Act would become the second major crypto law passed by Congress, following the GENIUS Act.
