This <a href="https://www.whitehouse.gov/briefing-room/statements-releases/2022/09/16/fact-sheet-white-house-releases-first-ever-comprehensive-framework-for-responsible-development-of-digital-assets/" rel="noopener noreferrer nofollow">framework</a> delegated authority to established market regulators like the Commodity Futures Trading Commission (CFTC) and the Securities and Exchange Commission (SEC).

The SEC has been actively overseeing the industry, evidenced by its extensive actions against crypto-focused businesses and ventures. Legal actions, including lawsuits and complaints, have been brought against entities like Ripple, Coinbase, and Binance for their cryptocurrency-related offerings.

However, a significant development occurred in 2023 when a district court of appeals ruled that Ripple's sale of XRP constituted securities offerings solely when targeting institutional buyers, not when traded on exchanges. This marked a partial victory for the crypto sphere.&nbsp;

Subsequently, in November, another ruling overturned the SEC's rejection of Grayscal's Bitcoin ETF Trust application, prompting a re-evaluation by the Commission. Eventually, in January 2024, the first Bitcoin Spot ETFs gained approval.

India's stance on cryptocurrencies has been evolving over the past few years. The Finance Bill 2022 categorised virtual digital assets as property and implemented a <a href="https://www.koinx.com/crypto-tax-guides/india" rel="noopener noreferrer nofollow">crypto tax in India.&nbsp;</a>
People involved in mining, staking, acquiring airdrops or earning salaries in crypto will be liable to pay income tax based on the regular tax slab.&nbsp;&nbsp;
Moreover, crypto traders/investors in India will pay a flat tax of 30% on crypto gains and a 1% tax deduction at source (TDS) on crypto trades. Additionally, they are liable to pay a 4% cess on the taxable capital gains.

Although cryptocurrency isn't recognised as legal tender in Canada, the country stands out for its proactive crypto regulation. Canada made history by approving the first Bitcoin exchange-traded fund (ETF) available for trading on the Toronto Stock Exchange.
Crypto trading platforms must register with provincial regulators as mandated by the <a href="https://www.securities-administrators.ca/" target="_blank" rel="noopener noreferrer nofollow">Canadian Securities Administrators</a> (CSA) and the <a href="https://www.iiroc.ca/" target="_blank" rel="noopener noreferrer nofollow">Investment Industry Regulatory Organization of Canada</a> (IIROC).
All crypto investment firms fall under the money service businesses (MSBs) classification and must register with Canada's Financial Transactions and Reports Analysis Centre (FINTRAC). Regarding taxation, Canada treats cryptocurrency similarly to other commodities.
<h3 dir="ltr" id="span-united-kingdom-striking-a-balance-span">United Kingdom: Striking a Balance</h3>
In October 2022, the British Parliament's lower house officially acknowledged crypto assets as regulated financial instruments. The Financial Services and Markets bill transformed into law in June 2023, extending existing regulations to encompass all aspects of crypto assets, services, and providers.
<a href="https://www.gov.uk/hmrc-internal-manuals/cryptoassets-manual/crypto100350" target="_blank" rel="noopener noreferrer nofollow">Specific reporting requirements</a> concerning Know Your Client (KYC) standards, along with measures against money laundering (AML) and terrorism financing (CFT), are now applicable to cryptocurrency.
While investors remain subject to capital gains tax on crypto trading profits, the overall tax implications hinge on the nature of crypto activities and the parties involved in the transactions.
To align with regulations, crypto exchanges and custodian wallet providers must adhere to the reporting obligations outlined by the Office of Financial Sanctions Implementation (OFSI). Immediate notification to the OFSI is mandatory for crypto firms if they possess knowledge or reasonable suspicion of an individual being subject to sanctions or committing a financial sanctions offence.

Australia has classified cryptocurrencies as legal property, making them liable for capital gains tax. Exchanges can operate freely within the country, provided they register with the <a href="https://www.austrac.gov.au/business/your-industry/digital-currency-cryptocurrency/digital-currency-exchange-providers" target="_blank" rel="noopener noreferrer nofollow">Australian Transaction Reports and Analysis Centre</a> (AUSTRAC) and fulfil specific AML/CTF obligations.
In 2019, the <a href="https://asic.gov.au/regulatory-resources/digital-transformation/crypto-assets/" target="_blank" rel="noopener noreferrer nofollow">Australian Securities and Investments Commission</a> (ASIC) introduced initial coin offerings (ICOs) regulations and prohibited exchanges from offering privacy coins, ensuring anonymity by masking money flows.
In 2021, Australia revealed intentions to establish a cryptocurrency licensing system and potentially introduce a central bank digital currency (CBDC).
In October 2023, the Australian treasury proposed a regulatory framework, with a draft expected in 2024 and a 12-month transition period upon approval and implementation.

Additionally, cryptocurrencies were outright banned in September 2021.

Japan's approach to crypto regulations is forward-thinking, recognising cryptocurrencies as legal property under the Payment Services Act (PSA). Crypto exchanges in Japan must register with the Financial Services Agency (FSA) and adhere to AML/CFT obligations.&nbsp;
Established in 2020, the Japanese Virtual Currency Exchange Association (JVCEA) encompasses all crypto exchanges. Japan considers trading gains from cryptocurrency as miscellaneous income and taxes investors accordingly.
The government is actively refining regulations, including taxation. In September 2022, plans were announced to implement remittance rules by May 2023 to curb money laundering through cryptocurrency exchanges. Amendments to the Act on Prevention of Transfer of Criminal Proceeds will enable the collection of customer information.
<h3 dir="ltr" id="span-singapore-fostering-innovation-and-growth-span">Singapore: Fostering Innovation and Growth</h3>
Like the U.K., Singapore also categorises cryptocurrency as property rather than legal tender. The <a href="https://sso.agc.gov.sg/Acts-Supp/2-2019/Published/20190220?DocDate=20190220" target="_blank" rel="noopener noreferrer nofollow">Monetary Authority of Singapore</a> (MAS) oversees and regulates exchanges according to the Payment Services Act (PSA).
In 2022, Singapore issued guidelines cautioning providers of digital payment tokens (DPT) against promoting their services to the public.
By August 2023, MAS introduced a framework to oversee stablecoin issuance, stipulating specific criteria for approval. Stablecoin issuers must obtain MAS approval to label their stablecoins as "MAS-regulated," distinguishing them from non-regulated counterparts.
Singapore's status as a cryptocurrency haven partly stems from its policy of not taxing long-term capital gains. However, companies engaging in regular cryptocurrency transactions are subject to income tax on their profits.
