For an ETF to be approved, JPMorgan’s Nikolaos Panigirtzoglou told The Block that the United States Securities and Exchange Commission (SEC) would need to classify Ethereum as a commodity, akin to <a href="https://thecoinrise.com/is-bitcoin-legal/">Bitcoin (BTC)</a>, rather than a security. This distinction is crucial, as securities fall under a different set of regulations compared to commodities. 
However, according to Nikolaos, “this is far from given, as he wouldn’t put more than a 50% chance to the SEC classifying Ethereum as a commodity before May.” 
Currently, Bitcoin is considered a commodity, and <a href="https://thecoinrise.com/us-sec-grants-official-approval-for-a-spot-bitcoin-etf/">several BTC ETFs have received approval.</a> However, Ethereum’s regulatory status is less clear and officially classified as a security by the SEC. To greenlight a spot ETH ETFs, the SEC would have to revise this classification, deeming Ethereum a commodity.

In their analysis, JPMorgan analysts emphasize the significant role the SEC plays in determining the future of an Ethereum ETF. While the cryptocurrency community awaits this decision, uncertainty looms over the future of Ethereum ETFs.

As reported, Nasdaq, acting on behalf of <a href="https://thecoinrise.com/nasdaq-filing-confirms-blackrocks-spot-ethereum-etf-push/">BlackRock, filed a 19b-4 form, outlining the proposed “iShares Ethereum Trust.</a>” BlackRock’s pursuit of an ETH-centric ETF is a strategic response to the growing demand for investment products tied to this second-largest cryptocurrency. Similarly, Grayscale, a prominent digital asset management firm, <a href="https://thecoinrise.com/grayscale-seeks-to-convert-ethereum-trust-to-spot-etf/">applied to convert its Grayscale Ethereum Trust to a spot Ethereum ETF</a>. 
Likewise, Fidelity Investments joined the ranks of financial giants seeking approval for a spot ETH ETF by submitting its application with the SEC. The asset management firm <a href="https://thecoinrise.com/fidelity-investments-seeks-sec-approval-for-its-ethereum-etf/">outlined its intent to launch the “Fidelity Ethereum Fund”</a>, positioning itself to track the performance of Ethereum.
