<p>Former FTX CEO Sam Bankman-Fried’s lawyers have argued that a motion by the Department of Justice to revoke his bail was based on a “thin” factual basis and would violate his right to free speech. Prosecutors requested the revocation after Bankman-Fried shared private diaries written by former Alameda Research CEO Caroline Ellison with the New York Times. Bankman-Fried’s lawyers said the DOJ’s version of events was mischaracterized,” and his communications with the reporter were not an attempt to intimidate Ellison or taint the jury pool. They also argued that detaining him would raise “serious First Amendment concerns.</p>
