A UK trader has filed a High Court claim against BitMEX operator HDR Global Trading Limited, seeking the return of 324.8 BTC allegedly lost in derivatives trades conducted without proper regulatory authorisation, just three weeks after the exchange permanently ceased operations.

What to Know About the UK Trader's 324 BTC Request

Lewis Barber filed the claim against HDR Global Trading Limited, the entity behind BitMEX, according to The Guardian, which reported on 14 October 2026 that the claim had been filed but had not yet been served on the company. The distinction matters: a filed but unserved claim is a legal allegation, not a court finding.
Amount sought: Barber reportedly seeks the return of 324.8 BTC, equivalent to roughly $26.5 million at current prices.

Legal basis: The claim alleges BitMEX offered crypto-derivative products to UK investors without authorisation from the Financial Conduct Authority, and that Barber is entitled to restitution under the Financial Services and Markets Act 2000. This is Barber's legal position; it has not been tested in court.

The trades at the centre of the claim span 2018 to 2022, a period during which BitMEX operated as one of the world's largest Bitcoin derivatives venues. The Guardian reported that the FCA issued a warning about BitMEX on or around 3 March 2020, providing context for the regulatory argument now embedded in Barber's filing.
Cryptopolitan reported that Barber is challenging 1,053 losing perpetual-swap trades out of approximately 2,294 trades executed across five accounts. Perpetual swaps are leveraged Bitcoin-settled contracts with no expiry date; they are a staple instrument of offshore derivatives exchanges and carry significant liquidation risk for retail participants.
Why the Timing After BitMEX's Closure Matters

BitMEX ceased all exchange operations on 23 September 2026. Trading, deposits, and new positions were shut down; login and withdrawals remained available to allow users to recover funds. The Guardian's report of Barber's filing appeared exactly 21 days later, on 14 October 2026.

The timing places the claim in a compressed window: BitMEX's exchange infrastructure has already gone dark, yet the company's legal entity, HDR Global Trading Limited, remains the named defendant. The fact that the claim had not yet been served as of the Guardian's reporting means HDR had not yet been formally required to respond in court proceedings.

For Bitcoin holders and those tracking regulatory pressure on offshore derivatives venues, the case connects directly to longstanding concerns about platforms that served UK retail traders outside the FCA's authorisation perimeter. Similar regulatory-gap arguments have surfaced in disputes involving exchange compliance and investor protections more broadly.

What Could Happen Next in the 324 BTC Claim

The immediate procedural step is service of the claim on HDR Global Trading Limited. Until the claim is served, the defendant has no formal obligation to respond. A response from BitMEX or its legal representatives would be the first material development to watch.

If the claim proceeds, the court will need to assess whether BitMEX's contracts with Barber were rendered unenforceable by the absence of FCA authorisation under the Financial Services and Markets Act 2000, and whether that unenforceability entitles Barber to the return of the bitcoin or equivalent damages. That is Barber's stated legal theory, according to reporting on the filing; it is not a settled legal position.

Bitcoin itself was trading at $81,649 at the time of writing, down roughly 1.8% over 24 hours, giving the 324.8 BTC sought a present-day dollar value in the region of $26.5 million. The Crypto Fear & Greed Index stood at 62, indicating a market in Greed territory, which has no bearing on the legal proceedings but contextualises the current value of the assets at stake.

Verified filings, a court-assigned hearing date, or any settlement discussions would represent the next concrete milestones. Given that BitMEX has wound down exchange operations, attention will also focus on whether sufficient assets remain within HDR Global Trading Limited to satisfy any eventual award, should Barber's claim succeed. Broader questions about regulatory compliance in offshore Bitcoin derivatives markets, a topic also relevant to other major exchange operators adjusting their business scope, are likely to be examined as the case develops.
