The Commodity Futures Trading Commission has sent a crypto market rulemaking to White House review, moving ahead on agency authority as Congress failed to advance a comprehensive legislative framework. The filing, registered under RIN 3038-AF80 and titled "Regulation Crypto Asset Transactions and Regulation Crypto Asset Markets," arrived at the Office of Information and Regulatory Affairs on September 17, 2026, placing the initiative in a pre-adoption review stage while the Digital Asset Market CLARITY Act remains stalled in the Senate.

The OIRA public record classifies the CFTC submission as a prerule, not a finalized or adopted regulation, and marks it as not economically significant. OIRA received the filing on 09/17/2026, according to the official federal regulatory docket.
The docket identifies the submission under RIN 3038-AF80 in the federal review system. The submission is classified as a prerule in the federal review system, meaning it precedes any notice-and-comment rulemaking and has not yet established binding obligations for market participants.
Critically, the text of the prerule has not been made public. According to CoinDesk, details including which crypto assets the proposal covers, exchange qualification requirements, trading restrictions, and the asserted reach of CFTC authority have not been disclosed. The CFTC's draft crypto market rules reaching this stage marks the furthest the agency has advanced on a formal market-structure framework for digital assets.

Why the CLARITY Act's Stall Matters for Crypto Oversight

The Senate motion to proceed on the Digital Asset Market CLARITY Act received 50 votes for and 49 against, falling short of the 60-vote threshold required to clear the procedural cloture hurdle, according to CNBC. The bill's failure to advance left the legislative track for comprehensive digital asset regulation effectively stalled, shifting attention toward agency-level rulemaking as the operative path forward.

The juxtaposition is direct: with Congress unable to produce a statutory framework, the CFTC is proceeding under existing authority. Industry executives told CoinDesk that the Senate setback leaves the market dependent on agency rules that a future administration could change, rather than a durable statutory framework. Ripple CEO Brad Garlinghouse said the Senate outcome left consumers and U.S. competitiveness behind after an industry-wide push for the bill.

The CFTC's move to advance its own framework while the CLARITY Act stalls mirrors a broader pattern discussed when the agency moved ahead with crypto rules in the absence of congressional action. For Bitcoin specifically, the regulatory question centers on whether commodity classification, which the CFTC has long asserted for BTC, is codified by statute or remains subject to inter-agency dispute without legislative resolution.

Bitcoin traded at $80,464 at the time of publication, down approximately 1% over 24 hours, with a market capitalization near $1.62 trillion. The Crypto Fear & Greed Index read 71, indicating a Greed sentiment reading, suggesting market participants have not materially repriced risk in response to the regulatory uncertainty.

What to Watch Next

The OIRA review process is the next milestone on the regulatory track. Once OIRA completes its review, the CFTC could proceed toward a formal notice-and-comment rulemaking, at which point the proposal's contents would become public. The timeline for that review is not fixed, and OIRA may return the filing, approve it, or require revisions before any next step occurs.

On the legislative track, any renewed attempt to advance the CLARITY Act would require overcoming the same 60-vote cloture threshold that blocked the bill's most recent procedural motion. The SEC and CFTC have taken separate steps in recent months, and absent a unified statutory directive from Congress, that divergence in jurisdictional approach is likely to persist through the OIRA review period and beyond.
