<p>The U.S. Securities and Exchange Commission (SEC) has been dealt a blow in its regulatory overreach against the crypto industry. A federal judge has ordered the SEC to pay $1.8 million in legal fees to the decentralized finance (DeFi) lending platform Lendbox after the commission engaged in "bad faith" conduct during its case against the project.</p>
<p>The ruling stems from the SEC's failed attempt to obtain a preliminary injunction freezing Lendbox's assets back in 2022. The court found that the SEC made misrepresentations and false statements in its efforts to secure the injunction, constituting "bad faith" conduct that warrants sanctions against the regulator. This outcome is seen as a major victory for the DeFi project and the broader crypto community battling overaggressive SEC enforcement actions.</p>
<p>While $1.8 million may seem like a small sum for a regulator like the SEC, the reputational damage could be far more significant. The case highlights concerns over the SEC's approach to crypto regulation under Chair Gary Gensler's leadership. Gensler has faced bipartisan criticism for overstepping the SEC's authority and stifling innovation in the digital asset space through excessive enforcement.</p>
