<p>The Securities and Exchange Commission (SEC) is facing intense scrutiny from lawmakers over its approach to regulating the cryptocurrency industry. Representative Tom Emmer accused SEC Chair Gary Gensler of "regulatory hypocrisy, inconsistency, and incompetence," particularly with the controversial Staff Accounting Bulletin 121 (SAB 121). This guidance, which prevents banks from safeguarding consumer-owned digital assets, has drawn criticism for overstepping the SEC's authority and hampering the growth of the crypto ecosystem in the United States.</p>
<p>Emmer argued that SAB 121 violates the SEC's statutory mission by introducing unnecessary concentration risks, weakening investor protections, and hindering capital formation and global competitiveness. House Republicans are set to pass a resolution by Congressman Mike Flood to nullify this rule, with hopes of garnering bipartisan support to ensure the digital asset ecosystem can thrive domestically.</p>

<p>Amidst the controversy, some lawmakers remain staunchly supportive of the SEC's enforcement actions against cryptocurrencies. Representative Brad Sherman praised the agency's actions against projects like FTX, arguing that the "crypto industry is a garden of snakes." However, others contend that the SEC is overstepping its boundaries and that Congress should clarify its authority over the rapidly evolving digital asset space.</p>
<p>As the debate rages on, industry experts and legal scholars are calling for Congress to enact clarifying amendments to prevent uncertainty and inconsistency in the regulation of cryptocurrencies. With the crypto industry rapidly evolving, the need for clear and effective regulatory frameworks has become increasingly urgent, prompting lawmakers to take a closer look at the SEC's approach and consider legislative action to ensure the responsible growth of this innovative sector.</p>
