<p>In a bid to bring clarity to the often murky waters of artificial intelligence (AI) in healthcare, the Health and Human Services (HHS) has instituted a pivotal measure – the AI Transparency Rule (HTI-1). While lauded for its attempt to illuminate the intricacies of predictive AI models, experts caution that the rule, while beneficial, may fall short of providing a holistic solution to the challenges ingrained in this rapidly advancing technology.</p>
<p>The AI Transparency Rule stems from the recognition of a pervasive lack of transparency in the healthcare AI marketplace, particularly concerning predictive models. Jeff Smith, Deputy Director of Certification and Testing at HHS’s Office of the National Coordinator (ONC) for Health Information Technology, underscores the urgency behind this initiative. The rule seeks to address the scarcity of information regarding the design, development, testing, training, and evaluation of predictive AI models, which has led to documented harms affecting millions of Americans.</p>

<p>Under the AI Transparency Rule, ONC has finalized two overarching policy categories. <p>Mandar Karhade, Leader of Data and Analytics at Avalere Health, emphasizes that the intent behind some AI models is not always transparent. Whether the goal is diagnosis, cost-saving, or another objective, the lack of clarity poses potential challenges. Electronic Health Records (EHRs) emerge as a susceptible domain, with AI features like Oracle’s “autocomplete” raising concerns about accuracy and unintended data additions.</p>
<p>Jeff Smith draws parallels between the AI Transparency Rule and a nutrition label for food, highlighting its role in providing essential information. Meghan O’Connor, a legal expert from Quarles &amp; Brady, challenges this analogy, pointing out the subjective and immeasurable nature of the information disclosed. This raises questions about how health IT developers communicate such information and how providers integrate it into their risk analysis.</p>

<p>Niam Yaraghi, a nonresident senior fellow at the Brookings Institution, offers a critical perspective. Yaraghi advocates for policies fostering rapid advancements in AI and addressing barriers like data silos in the healthcare system.</p>
