The Appeal Court of Montenegro has overturned the Higher Court’s decision on the <a href="https://news.todayq.com/do-kwon-set-to-extradite-us-rather-than-south-korea/" target="_blank" rel="noreferrer noopener">extradition requests</a> for Do Kwon, co-founder of Terraform Labs, This ruling comes after a council session and a subsequent review of the case, highlighting concerns about procedural errors. Do Kwon dodge extradition 
The official announcement stated that the Higher Court’s initial decision, dated November 17, 2023, had previously approved the extradition requests made by both the Republic of South Korea and the United States. The <a href="https://news.todayq.com/do-kwon-extradition-from-montenegro-approved-to-be-jailed-us/" target="_blank" rel="noreferrer noopener">charges against Do Kwon</a> include multiple criminal offenses, prompting the extradition requests for his criminal prosecution. 
The defendant’s legal representatives filed an appeal asserting a violation of criminal procedure. The Appeal Court agreed with the defense and pointed out that the initial decision lacked clear reasoning on crucial facts. However, the court canceled out the ruling and sent the case to the lower court for a thorough reevaluation. 
Earlier, Montenegro’s High Court extended the detention of Do Kwon, responding to extradition requests from the US and South Korea. The court prolonged Kwon’s custody which was set to expire in December, by two months until Feb. 15. Both countries seek Kwon for charges linked to the 2022 collapse of TerraUSD, an algorithmic stablecoin. Why was the ruling got overruled? 
The release mentioned that Kwon had consented to expedited extradition proceedings for South Korea’s request. The court received the US request before Kwon’s hearing, yet he was not allowed to present his defense. 
It added that in a prior session on November 13, 2023, the Appeal Court also nullified another decision by the Higher Court. This decision postponed Do Kwon’s extradition until he completed a 4-month prison sentence from a final judgment by the Basic Court in Podgorica. 
The Appeal Court based its cancellation on violations of criminal procedure provisions. It highlighted that the determination of whether extradition should be postponed is within the jurisdiction of the Minister of Justice.
