<p>Cryptocurrency exchange Binance and its former CEO, Changpeng ‘CZ’ Zhao, have <a href="https://www.cftc.gov/PressRoom/PressReleases/8837-23">finalized</a> a $2.7 billion settlement with the Commodity Futures Trading Commission (CFTC), marking a pivotal moment in the regulation of the cryptocurrency industry.</p> 
<p>This settlement concludes a protracted legal dispute, receiving acknowledgment from a federal judge. The case involved allegations of Binance violating the Commodity Exchange Act (CEA) and CFTC regulations by actively soliciting U.S. customers, in contravention of its Terms of Use.</p> 
<h2 class="wp-block-heading" id="h-settlement-details"><strong>Settlement Details:</strong></h2> 
<p>Changpeng Zhao is mandated to pay $150 million personally, with a significant portion due within the next thirty days. Binance faces a dual financial penalty: it must return $1.35 billion in “ill-gotten transaction fees” and pay an additional $1.35 billion as a fine to the CFTC. </p> 
<p>The settlement also includes stringent new Know Your Customer (KYC) policies for Binance and the establishment of a formal corporate governance structure, encompassing an audit committee, a compliance committee, and an independent board of directors. In a related action, Samuel Lim, Binance’s former Chief Compliance Officer, is required to pay a $1.5 million civil monetary penalty for his role in the company’s regulatory breaches.</p>
