Tech giant Elon Musk and billionaire investor Mark Cuban, among others, have united to submit a shared amicus brief to the United States Supreme Court. The document raises critical concerns about the Securities and Exchange Commission’s (SEC) practice of conducting internal proceedings without the inclusion of juries. Musk and Cuban challenge SEC over Seventh Amendment rights 
Musk, as CEO of Tesla and SpaceX, and Cuban, a vocal advocate in the cryptocurrency and DeFi space, argue that the SEC’s administrative proceedings produce unreliable outcomes for individuals<a href="https://news.todayq.com/after-getting-sued-by-sec-musk-under-fire-for-suspension-of-pro-xrp-account/" rel="noopener noreferrer nofollow"> facing SEC charges</a>. They claim that this approach could potentially violate the Seventh Amendment right to a jury trial. 
The focal point of this legal challenge centers around the SEC v. Jarkesy case. George Jarkesy, the defendant, claims that his Seventh Amendment rights were violated. He argues that the SEC’s internal process, led by a judge chosen by the SEC and without a jury, violates these rights by concentrating too much power in one entity, acting as judge, jury, and enforcer. However, Musk and Cuban also highlight a significant change in the SEC’s approach from 2013 to 2014. The SEC began handling more cases internally instead of through federal courts, particularly after a series of unsuccessful insider trading cases tried before juries. Currently, Elon Musk is facing his third significant <a href="https://news.todayq.com/musk-accuses-sec-and-doj-of-abusing-their-regulatory-powers/" rel="noopener noreferrer nofollow">legal dispute with the SEC</a>, following previous lawsuits in 2018 and 2019. The agency aims for his recent $44 billion acquisition of ‘X’ (formerly Twitter), focusing on his public statements about the transaction.
Despite these legal challenges, Musk and Cuban are urging the Supreme Court to support the decision made by the 5th Rotation.&nbsp;
Their legal representatives argue that favoring administrative proceedings over federal court juries contradicts the SEC’s mission and could negatively impact investors and the markets the SEC aims to protect. Moreover, such decisions could potentially have adverse effects on both investors and the markets that the SEC is dedicated to safeguarding.
