In a rapidly evolving world where artificial intelligence (AI) is pushing the boundaries of what’s possible, the question of regulating AI technology has moved to the forefront of global discussions. As AI, exemplified by ChatGPT, becomes increasingly integrated into our daily lives, concerns about its potential for misuse and harm have sparked debates about the need for regulation. Amidst these conversations, an unexpected and complex question has arisen: Does AI deserve the right to free speech? 
AI’s remarkable advancements have transformed how we access information and find answers to our questions. It has become an indispensable tool, supporting our cognitive processes and decision-making. This raises a fundamental question about the relationship between AI and human rights. 
<h2 class="wp-block-heading" id="ai-s-role-in-shaping-free-thought">AI’s role in shaping free thought</h2> 
One key aspect of this debate stems from the recognition of human rights in international law, particularly the right to freedom of thought. This right underscores the importance of fostering an environment where individuals can think freely and without constraint. Some argue that if AI contributes to human thinking, it might necessitate granting AI the right to speak freely. 
Drawing parallels with corporations, which, like AI, are not individuals, raises intriguing questions. In the United States, the Supreme Court has ruled that the government should not suppress corporations’ political speech, emphasizing the importance of diverse and antagonistic sources to protect Americans’ freedom to think for themselves. Transposing this principle to AI suggests that the identity of the speaker may not be the critical factor; instead, what matters is their contribution to the marketplace of ideas. 
However, granting AI free speech rights is not without its challenges. An unbridled AI could inundate the information landscape with misinformation and propaganda, posing a significant risk to society. Yet, combating falsehoods could easily veer into censorship, thereby undermining the very principles of free speech. The solution might lie in using AI to counter misinformation, thereby striking a balance between promoting truth and allowing diverse perspectives. 
AI’s influence on human thought is another critical consideration. With its unprecedented capacity to shape narratives, control attention, and manipulate reasoning, AI has the potential to undermine free thought by discouraging reflection and promoting biased reasoning. This could lead to a society where machines mold our minds, challenging our traditional thinking habits. Humans have often been described as “cognitive misers,” thinking only when necessary. AI’s right to speak might compel us to think more deliberately about the truth. 
The enormous quantity of speech that AI can produce could grant it an oversized influence on society. Currently, the U.S. Supreme Court views silencing some speakers to amplify others as incompatible with the First Amendment. However, striking a balance between protecting human discourse and thought while allowing AI speech might require reconsidering this stance. 
The European Union has stepped into this arena with its draft AI act, attempting to address some of these concerns. It mandates disclosure of AI-generated content, aiming to help consumers differentiate between human and AI-generated content, ultimately promoting free thought. Still, permitting some anonymous AI speech could encourage more objective evaluations, rather than reflexively dismissing it as “bot speech.” 
<h2 class="wp-block-heading" id="navigating-the-free-speech-tightrope-for-ai">Navigating the free speech tightrope for AI</h2> 
However, regulating AI’s speech is not without its challenges. The EU Act also requires AI models to avoid generating illegal content, including hate speech. While this aims to curb harmful content, it may inadvertently suppress legal speech. Holding companies liable for AI-generated content might lead to unnecessary restrictions, necessitating new laws to protect corporations from undue pressure. 
As technology continues to evolve, new rights and regulations may be necessary to safeguard our interactions with AI and computers. The concept of a “right to think with technology” encompasses the freedom to engage with AI while ensuring safety and alignment with human values. This concept challenges recent calls for AI to be “safe, aligned, and loyal,” prompting a deeper examination of the intersection between AI and human thought.
