 <p><a rel="noopener noreferrer nofollow" title="Apple" href="https://thebittimes.com/tag/apple.html">Apple</a> will pay out between $310 million and $500 million in <a rel="noopener noreferrer nofollow" title="settlement" href="https://thebittimes.com/tag/settlement.html">settlement</a> to nearly 3 million users of pre-2018 iPhones. According to a statement from lawyers for <a rel="noopener noreferrer nofollow" title="Apple" href="https://thebittimes.com/tag/apple.html">Apple</a> customers, the payouts will go to affected users who filed claims against the tech giant in 2020 for the notorious “batterygate” issue.</p>

 <p>The class action was filed back in 2018. In 2019, the Court ruled on Apple’s motion to dismiss and allowed several claims in the litigation to move forward. This included violation of the federal Computer Fraud and Abuse Act, California’s Computer Data Access and Fraud Act, California’s Unfair Competition Law, and Trespass to Chattels.&nbsp;Apple was accused of purposely slowing down older iPhone models during that period. Hence, convincing users to upgrade to the latest generation of phones.</p>

 <p>Mark C. Molumphy, a partner at Cotchett, Pitre &amp; McCarthy, LLP said the following about the settlement: </p>

We are extremely proud that this deal has been approved, and following the Ninth Circuit’s order, we can finally provide immediate cash payments to impacted <a rel="noopener noreferrer nofollow" title="Apple" href="https://thebittimes.com/tag/apple.html">Apple</a> customers</em>.”</p>

 <p><a rel="noopener noreferrer nofollow" title="Apple" href="https://thebittimes.com/tag/apple.html">Apple</a> agreed to pay between $310 million and $500 million in cash compensation <a rel="noopener noreferrer nofollow" title="settlement" href="https://thebittimes.com/tag/settlement.html">settlement</a> to users who filed claims. It is unknown when these payouts will be delivered.</p> 
 <p>Tyson C. Redenbarger, a partner at Cotchett, Pitre &amp; McCarthy, LLP adds, “This was an important case, lying at the intersection of privacy, consumer product, and computer intrusion laws. The settlement provides substantial relief to Apple consumers and, going forward, will help ensure that customers are fully informed when asked to update their products.”</p>
