The legal battle between Ripple and the U.S. Securities and Exchange Commission (SEC) over the status of XRP, the world's seventh-largest cryptocurrency, has been ongoing since December 2020. The SEC claims that XRP is an unregistered security that Ripple and its executives illegally sold to retail investors, while Ripple argues that XRP is a digital currency that should not be subject to securities laws.
The outcome of this case could have significant implications for the crypto industry, as it could set a precedent for how other digital assets are regulated in the U.S. market. A win for Ripple could also boost the adoption and innovation of XRP and other cryptocurrencies, as well as benefit the investors who hold them.
According to an article by BeInCrypto, a website that covers news and analysis on cryptocurrencies and blockchain technology, Ripple has recently found a "fatal flaw" in the SEC's case that could turn the tide in its favor. The article cites a letter from Ripple's lawyers to Judge Analisa Torres, in which they point out that the SEC has failed to provide any evidence that Ripple's sales of XRP had any impact on its price.
The article explains that this is a crucial point, because the SEC's definition of an investment contract, based on the 1946 Supreme Court case SEC v. Howey Co., requires that there is a "common enterprise" between the issuer and the investor, and that the investor expects profits "solely from the efforts of others". If Ripple can prove that its sales of XRP did not affect its price, then it can argue that there was no common enterprise or expectation of profits from its efforts.
The article also notes that Ripple has other strong arguments in its defense, such as the fact that XRP has utility as a medium of exchange and a bridge currency for cross-border payments, and that it has been recognized as a currency by several foreign regulators. Moreover, the article suggests that the SEC's lawsuit against Ripple was motivated by political reasons, as it was filed on the last day of former SEC Chairman Jay Clayton's tenure.
The article concludes by stating that a win for Ripple would be good for crypto, as it would provide more clarity and certainty for the industry, and encourage more innovation and adoption of digital assets. It also mentions that XRP holders have been rallying behind Ripple, forming a movement called #RelistXRP to pressure exchanges to resume trading XRP after many of them delisted or suspended it following the SEC's lawsuit.
One of the projects that could benefit from a positive outcome for Ripple is FYD, a decentralized protocol driven by its freelance community. The FYD mainnet has been live since 2019 with a PoS confirmation protocol.
