Jeff Smith, Deputy Director of Certification and Testing at HHS’s Office of the National Coordinator (ONC) for Health Information Technology, underscores the urgency behind this initiative. The rule seeks to address the scarcity of information regarding the design, development, testing, training, and evaluation of predictive AI models, which has led to documented harms affecting millions of Americans.</p>

Electronic Health Records (EHRs) emerge as a susceptible domain, with AI features like Oracle’s “autocomplete” raising concerns about accuracy and unintended data additions.</p>
<p>Jeff Smith draws parallels between the AI Transparency Rule and a nutrition label for food, highlighting its role in providing essential information. Meghan O’Connor, a legal expert from Quarles &amp; Brady, challenges this analogy, pointing out the subjective and immeasurable nature of the information disclosed. This raises questions about how health IT developers communicate such information and how providers integrate it into their risk analysis.</p>
