However, the lawsuit alleges that he was dumping millions of XRP at that time. This means that while he was assuring people of his belief in the worth of XRP and that he was holding it, he was actually getting rid of a lot of it.
The judge, Phyllis Hamilton said that XRP might be considered a security when sold to regular people (not big investors).
