Binance’s tax evasion case has been set to be called to the bar on October 11th in a Nigerian court. The Presiding Judge, Emeka Nwite, disclosed this on Friday. The exchange is accused of four charges of tax evasion and non-declaration with Nigeria’s Federal Inland Revenue Service (FIRS).
Binance counsel Ayodele Omotilewa pleaded that the accused was not guilty of all the charges against him. Omotilewa, on his part, moved to have the charges answered against him withdrawn, saying that the case does not hold any substance.
He recalled the exact circumstances of the previous release of Binance executives Tigran Gambaryan and Nadeem Anjarwalla from charges.

Omotilewa stated that the allegations leveled against Binance were baseless. He noted that in June, the court freed Gambaryan and Anjarwalla from charges similar to tax evasion. However, the two executives still have other charges of money laundering that they are answering, which they have denied.
Judge Nwite then ruled that the case would be assisted in October to allow for more discussion. This extension will benefit the defense and the prosecution by giving them more time to prepare. When the court resumes functioning, both parties will review the evidence and come up with stronger arguments.

The Nigerian government has alleged that some economic problems associated with Binance are the cause. They say this is due to the platform’s involvement in trading the Nigerian naira during acute dollar scarcity, which they say has led to the currency’s record low.
Regarding the trading problems, Binance ceased converting USDT to naira in February. They turned off the ‘Buy’ button and fixed the N1,802 to a dollar rate, saying they were acting to prevent fraud. After these events, Nigerian authorities restricted access to significant cryptocurrency exchanges, including Binance.
In March, Binance halted all Nigerian Naira operations. They suspended deposit and withdrawal possibilities and removed naira trading pairs. Customers had three days to withdraw their naira balance or convert it to USDT.
The crackdown is in harmony with the National Security Adviser’s perspective of cryptocurrency trading. The adviser considers it as a threat to national security. In this regard, the CBN requested fintech companies to observe and submit data on cryptocurrency activities.

The court’s decision in October will be central to Binance’s fate. The result may tremendously influence its business in Nigeria. Before the next hearing, both the defense and prosecution will try to build their cases.
It has also focused on the general effects of regulating cryptocurrency in a court of law. The decision made in Binance’s case may be used in situations similar to other cryptocurrency exchanges in Nigeria. This verdict will be of great interest to market participants and the authorities.
The trial sheds light on the issues of cryptocurrency exchanges operating within the legal framework. Binance’s legal representatives say the charges are baseless, while the Nigerian government is focused on economic and security risks. The court’s decision will most probably impact the regulator’s further actions.
Binance has, however, moved to have the charges thrown out of court. The company had earlier stated that its operations are in conformity with all applicable laws. However, the current legal battle indicates that the situation regarding using cryptocurrencies in Nigeria could be clearer.
