<p>If the judge dismisses Coinbase’s motion, it could dramatically alter the regulatory landscape for token sales, including XRP. Such a dismissal would weaken the SEC’s ability to appeal, nudging the agency toward a settlement with Ripple. Deaton posits that even if an appeal were plausible, the agency’s clout would wither, making a settlement increasingly favorable.</p> 
<p>Ripple, too, has not been idle. In a recent filing, it countered the SEC’s stance, arguing that the agency had deviated from legal norms, especially concerning the Howey test for token sales.</p> 
<p>This development comes after a favorable July ruling for Ripple, which has incited many exchanges to contemplate relisting XRP.
