(CFTC), Rostin Benham, recently <a href="https://www.bloomberg.com/news/articles/2023-05-18/transcript-cftc-chair-rostin-behnam-on-the-fight-to-regulate-crypto" rel="noopener noreferrer nofollow">stated</a> that his agency does not have the power to regulate the buying and selling of cryptocurrencies with cash.In an interview, Benham explained that the CFTC&#39;s authority is limited to overseeing cash markets if there is fraud or manipulation involved. However, he emphasized that the CFTC will still regulate the cryptocurrency industry in other ways. He mentioned incidents from 2022 and expressed his commitment to protecting investors within the agency&#39;s scope.Benham also acknowledged that many cryptocurrencies could be considered financial assets, similar to commodities. The CFTC can apply regulations, notices, advisories, and enforcement actions to these assets. He previously stated that certain cryptocurrencies like Ethereum and stablecoins are commodities.Moreover, Benham suggested that while cryptocurrencies raise new challenges, existing policy approaches can be adapted to address them effectively.The CFTC&#39;s role in regulating cryptocurrencies is significant because it is one of the two US government agencies responsible for overseeing the industry, along with the US Securities and Exchange Commission (SEC).The SEC&#39;s chair, Gary Gensler, has suggested that the CFTC should regulate specific assets as long as it does not encroach on the SEC&#39;s authority.
