Floyd Mayweather Joins Kim K in Pushing to Get Ethereum Max Lawsuit Dismissed

His lawyers claim the class action "is a transparent attempt to reach a perceived deep pocket" — and argue that he never made a public statement about EMAX.

Floyd Mayweather has filed a motion to dismiss the claims against him in a class action lawsuit centered on Ethereum Max.

The boxer has been accused of making false and misleading statements as he promoted this digital asset.

Kim Kardashian, who is also named in the lawsuit, has also filed her own motion to dismiss.

His lawyers argue that the class action "does not identify a single statement made by Mayweather about EMAX tokens or Ethereum Max."

They go on to argue that the evidence provided — such as him wearing clothing bearing Ethereum Max's logo — is insufficient.

Lawyers also claim that there is no evidence he ever received EMAX tokens. They added:

"Plaintiffs' pursuit of claims against Mayweather is a transparent attempt to reach a perceived deep pocket in an effort to obtain a windfall for an admitted 'highly speculative' and 'risky' investment that resulted in disappointment. The law does not support such claims."

Kim Kardashian had posted on Instagram about Ethereum Max, and has faced allegations of being involved in a scheme to artificially inflate the token's price.

In her motion to dismiss, lawyers said "no named plaintiff alleges that they in fact viewed either Instagram post before purchasing tokens during the relevant time period."

One Instagram post is clearly marked as an ad, with a disclaimer to warn that it should not be treated as investment advice. To give you a flavor of the content, one of the posts said:

"Are you guys into crypto???? This is not financial advice but sharing what my friends just told me about the Ethereum Max token! A few minutes ago Ethereum Max burned 400 trillion tokens — literally 50% of their admin wallet — giving back to the entire E-Max community."

Kim K's lawyers added that the plaintiffs cannot prove that she was actually compensated in EMAX tokens, or whether she had bought or sold this cryptocurrency at the time.

Ethereum Max has fallen by 99% since hitting an all-time high of $0.00000092 in May 2021. Crucially, it's not to be confused with Ether, the world's second-largest cryptocurrency.

The basketball player and pundit Paul Pierce has also been named in the lawsuit.
